55 AN ACT
66 relating to including certain veterans service organizations as
77 small businesses for the purpose of state contracting.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Subsection (a), Section 2155.505, Government
1010 Code, is amended by amending Subdivision (2) and adding Subdivision
1111 (3) to read as follows:
1212 (2) "Small business" means a small business concern as
1313 defined by regulations of the United States Small Business
1414 Administration in 13 C.F.R. Section 121.201 or a veterans service
1515 agency.
1616 (3) "Veterans service agency" means a community-based
1717 organization that:
1818 (A) is exempt from taxation under Section 501(a),
1919 Internal Revenue Code of 1986, as an organization described in
2020 Section 501(c)(3) of that code;
2121 (B) has as its principal purpose to provide
2222 housing, substance abuse treatment, case management services, and
2323 employment training to low-income veterans, disabled veterans, and
2424 homeless veterans and their families; and
2525 (C) employs veterans to provide at least 75
2626 percent of the hours of direct labor by individuals required to
2727 produce goods or provide services required under a contract entered
2828 into under this section.
2929 SECTION 2. Subsection (a), Section 2155.505, Government
3030 Code, as amended by this Act, applies only to a contract for the
3131 procurement of goods and services for which the solicitation of
3232 bids or proposals, request for proposals, or similar required
3333 notification as to the goods or services is published on or after
3434 September 1, 2009. A contract for the procurement of goods and
3535 services for which the solicitation of bids or proposals, request
3636 for proposals, or similar required notification as to the goods or
3737 services is published before September 1, 2009, is governed by the
3838 law in effect at the time the solicitation, request, or
3939 notification is published, and that law is continued in effect for
4040 that purpose.
4141 SECTION 3. This Act takes effect immediately if it receives
4242 a vote of two-thirds of all the members elected to each house, as
4343 provided by Section 39, Article III, Texas Constitution. If this
4444 Act does not receive the vote necessary for immediate effect, this
4545 Act takes effect September 1, 2009.
