| 6 | 6 | | relating to including certain veterans service organizations as |
|---|
| 7 | 7 | | small businesses for the purpose of state contracting. |

| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Subsection (a), Section 2155.505, Government |
|---|
| 10 | 10 | | Code, is amended by amending Subdivision (2) and adding Subdivision |
|---|
| 11 | 11 | | (3) to read as follows: |
|---|
| 12 | 12 | | (2) "Small business" means a small business concern as |
|---|
| 13 | 13 | | defined by regulations of the United States Small Business |
|---|
| 14 | 14 | | Administration in 13 C.F.R. Section 121.201 or a veterans service |
|---|
| 15 | 15 | | agency. |
|---|
| 16 | 16 | | (3) "Veterans service agency" means a community-based |
|---|
| 17 | 17 | | organization that: |
|---|
| 18 | 18 | | (A) is exempt from taxation under Section 501(a), |
|---|
| 19 | 19 | | Internal Revenue Code of 1986, as an organization described in |
|---|
| 20 | 20 | | Section 501(c)(3) of that code; |
|---|
| 21 | 21 | | (B) has as its principal purpose to provide |
|---|
| 22 | 22 | | housing, substance abuse treatment, case management services, and |
|---|
| 23 | 23 | | employment training to low-income veterans, disabled veterans, and |
|---|
| 24 | 24 | | homeless veterans and their families; and |
|---|
| 25 | 25 | | (C) employs veterans to provide at least 75 |
|---|
| 26 | 26 | | percent of the hours of direct labor by individuals required to |
|---|
| 27 | 27 | | produce goods or provide services required under a contract entered |
|---|
| 28 | 28 | | into under this section. |

| 29 | 29 | | SECTION 2. Subsection (a), Section 2155.505, Government |
|---|
| 30 | 30 | | Code, as amended by this Act, applies only to a contract for the |
|---|
| 31 | 31 | | procurement of goods and services for which the solicitation of |
|---|
| 32 | 32 | | bids or proposals, request for proposals, or similar required |
|---|
| 33 | 33 | | notification as to the goods or services is published on or after |
|---|
| 34 | 34 | | September 1, 2009. A contract for the procurement of goods and |
|---|
| 35 | 35 | | services for which the solicitation of bids or proposals, request |
|---|
| 36 | 36 | | for proposals, or similar required notification as to the goods or |
|---|
| 37 | 37 | | services is published before September 1, 2009, is governed by the |
|---|
| 38 | 38 | | law in effect at the time the solicitation, request, or |
|---|
| 39 | 39 | | notification is published, and that law is continued in effect for |
|---|
| 40 | 40 | | that purpose. |
|---|
| 41 | 41 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 42 | 42 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 43 | 43 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 44 | 44 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 45 | 45 | | Act takes effect September 1, 2009. |
