5	5	relating to provisional licensing of physicians to practice in
6	6	underserved areas.
7	7	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
8	8	SECTION 1. Subchapter C, Chapter 155, Occupations Code, is
9	9	amended by adding Section 155.101 to read as follows:
10	10	Sec. 155.101. PROVISIONAL LICENSE TO PRACTICE IN CERTAIN
11	11	AREAS. (a) On application, the board shall grant a provisional
12	12	license to practice medicine in a location described by Subsection
13	13	(e) to an applicant for a license under this subtitle who is
14	14	licensed in good standing as a physician in another state.
15	15	(b) The board may not grant a provisional license under this
16	16	section to an applicant who:
17	17	(1) has had a medical license suspended or revoked by
18	18	another state or a Canadian province; or
19	19	(2) holds a medical license issued by another state or
20	20	a Canadian province that is subject to a restriction, disciplinary
21	21	order, or probationary order.
22	22	(c) The provisional license applicant must:
23	23	(1) have passed a national or other examination
24	24	recognized by the board relating to the practice of medicine within
25	25	the number of attempts allowed under Section 155.056;
26	26	(2) submit information to enable the board to conduct
27	27	a criminal background check as required by the board; and
28	28	(3) be sponsored by a person licensed under this
29	29	subtitle with whom the provisional license holder may practice
30	30	under this section.
31	31	(d) The board may excuse an applicant for a provisional
32	32	license from the requirement of Subsection (c)(3) if the board
33	33	determines that compliance with that subsection constitutes a
34	34	hardship to the applicant.
35	35	(e) A person who holds a provisional license issued under
36	36	this section may only practice medicine in a location:
37	37	(1) designated by the federal government as a health
38	38	professional shortage area; or
39	39	(2) designated by the federal or state government as a
40	40	medically underserved area.
41	41	(f) A provisional license expires on the earlier of:
42	42	(1) the date the board issues the provisional license
43	43	holder a license under this subtitle or denies the provisional
44	44	license holder's application for a license; or
45	45	(2) the 270th day after the date the provisional
46	46	license was issued.
47	47	(g) The board shall issue a license under this subtitle to
48	48	the holder of a provisional license under this section if:
49	49	(1) the provisional license holder passes the
50	50	examination required by Section 155.051; and
51	51	(2) the provisional license holder satisfies all other
52	52	license requirements under this subtitle.
53	53	SECTION 2. Section 155.101, Occupations Code, as added by
54	54	this Act, applies to an application for a provisional license
55	55	submitted on or after January 1, 2010.
56	56	SECTION 3. This Act takes effect September 1, 2009.
