77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Subchapter C, Chapter 155, Occupations Code, is
99 amended by adding Section 155.101 to read as follows:
1010 Sec. 155.101. PROVISIONAL LICENSE TO PRACTICE IN CERTAIN
1111 AREAS. (a) On application, the board shall grant a provisional
1212 license to practice medicine in a location described by Subsection
1313 (e) to an applicant for a license under this subtitle who is
1414 licensed in good standing as a physician in another state.
1515 (b) The board may not grant a provisional license under this
1616 section to an applicant who:
1717 (1) has had a medical license suspended or revoked by
1818 another state or a Canadian province; or
1919 (2) holds a medical license issued by another state or
2020 a Canadian province that is subject to a restriction, disciplinary
2121 order, or probationary order.
2222 (c) The provisional license applicant must:
2323 (1) have passed a national or other examination
2424 recognized by the board relating to the practice of medicine within
2525 the number of attempts allowed under Section 155.056;
2626 (2) submit information to enable the board to conduct
2727 a criminal background check as required by the board; and
2828 (3) be sponsored by a person licensed under this
2929 subtitle with whom the provisional license holder may practice
3030 under this section.
3131 (d) The board may excuse an applicant for a provisional
3232 license from the requirement of Subsection (c)(3) if the board
3333 determines that compliance with that subsection constitutes a
3434 hardship to the applicant.
3535 (e) A person who holds a provisional license issued under
3636 this section may only practice medicine in a location:
3737 (1) designated by the federal government as a health
3838 professional shortage area; or
3939 (2) designated by the federal or state government as a
4040 medically underserved area.
4141 (f) A provisional license expires on the earlier of:
4242 (1) the date the board issues the provisional license
4343 holder a license under this subtitle or denies the provisional
4444 license holder's application for a license; or
4545 (2) the 270th day after the date the provisional
4646 license was issued.
4747 (g) The board shall issue a license under this subtitle to
4848 the holder of a provisional license under this section if:
4949 (1) the provisional license holder passes the
5050 examination required by Section 155.051; and
5151 (2) the provisional license holder satisfies all other
5252 license requirements under this subtitle.
5353 SECTION 2. Section 155.101, Occupations Code, as added by
5454 this Act, applies to an application for a provisional license
5555 submitted on or after January 1, 2010.
5656 SECTION 3. This Act takes effect September 1, 2009.
