| 7 | 7 | | certain liquid wastes. |

| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Subchapter B, Chapter 361, Health and Safety |
|---|
| 10 | 10 | | Code, is amended by adding Section 361.034 to read as follows: |
|---|
| 11 | 11 | | Sec. 361.034. RECORDS AND MANIFESTS REQUIRED FOR CERTAIN |
|---|
| 12 | 12 | | MUNICIPAL LIQUID WASTES. (a) The commission by rule shall require |
|---|
| 13 | 13 | | a person who generates, collects, conveys, transports, processes, |
|---|
| 14 | 14 | | stores, or disposes of municipal sewage sludge, grit trap waste, or |
|---|
| 15 | 15 | | grease trap waste to keep records and use, as prescribed by |
|---|
| 16 | 16 | | commission rule, a sequentially numbered, uniform transportation |
|---|
| 17 | 17 | | manifest issued by the commission to ensure that the waste is |
|---|
| 18 | 18 | | transported to an appropriate processing, storage, or disposal |
|---|
| 19 | 19 | | facility or site permitted or authorized for that purpose. |
|---|
| 20 | 20 | | (b) The rules must require the person who generates the |
|---|
| 21 | 21 | | waste, the person who transports the waste, and the person who |
|---|
| 22 | 22 | | disposes of the waste each to retain, for not less than three years, |
|---|
| 23 | 23 | | a copy of the uniform transportation manifest that records the |
|---|
| 24 | 24 | | generator, transporter, disposal site, and disposal method. |
|---|
| 25 | 25 | | (c) The rules must require that aggregate amounts of waste |
|---|
| 26 | 26 | | recorded on the manifests required under this section match the |
|---|
| 27 | 27 | | amounts of waste reported to the commission annually. The |
|---|
| 28 | 28 | | commission may require copies of uniform transportation manifests |
|---|
| 29 | 29 | | to be submitted with reports to the commission or at other times. |
|---|
| 30 | 30 | | SECTION 2. The Texas Commission on Environmental Quality |
|---|
| 31 | 31 | | shall adopt rules under Section 361.034, Health and Safety Code, as |
|---|
| 32 | 32 | | added by this Act, as soon as practicable so that the rules take |
|---|
| 33 | 33 | | effect not later than March 1, 2010. |
|---|
| 34 | 34 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 35 | 35 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 36 | 36 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 37 | 37 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 38 | 38 | | Act takes effect September 1, 2009. |
