77 certain liquid wastes.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Subchapter B, Chapter 361, Health and Safety
1010 Code, is amended by adding Section 361.034 to read as follows:
1111 Sec. 361.034. RECORDS AND MANIFESTS REQUIRED FOR CERTAIN
1212 MUNICIPAL LIQUID WASTES. (a) The commission by rule shall require
1313 a person who generates, collects, conveys, transports, processes,
1414 stores, or disposes of municipal sewage sludge, grit trap waste, or
1515 grease trap waste to keep records and use, as prescribed by
1616 commission rule, a sequentially numbered, uniform transportation
1717 manifest issued by the commission to ensure that the waste is
1818 transported to an appropriate processing, storage, or disposal
1919 facility or site permitted or authorized for that purpose.
2020 (b) The rules must require the person who generates the
2121 waste, the person who transports the waste, and the person who
2222 disposes of the waste each to retain, for not less than three years,
2323 a copy of the uniform transportation manifest that records the
2424 generator, transporter, disposal site, and disposal method.
2525 (c) The rules must require that aggregate amounts of waste
2626 recorded on the manifests required under this section match the
2727 amounts of waste reported to the commission annually. The
2828 commission may require copies of uniform transportation manifests
2929 to be submitted with reports to the commission or at other times.
3030 SECTION 2. The Texas Commission on Environmental Quality
3131 shall adopt rules under Section 361.034, Health and Safety Code, as
3232 added by this Act, as soon as practicable so that the rules take
3333 effect not later than March 1, 2010.
3434 SECTION 3. This Act takes effect immediately if it receives
3535 a vote of two-thirds of all the members elected to each house, as
3636 provided by Section 39, Article III, Texas Constitution. If this
3737 Act does not receive the vote necessary for immediate effect, this
3838 Act takes effect September 1, 2009.
