| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subsection (a), Section 43.024, Parks and |
|---|
| 11 | 11 | | Wildlife Code, is amended to read as follows: |
|---|
| 12 | 12 | | (a) Except as provided by Subchapter L, all [All] protected |
|---|
| 13 | 13 | | wildlife collected and subsequently held under this subchapter or |
|---|
| 14 | 14 | | rules adopted under this subchapter remain the property of the |
|---|
| 15 | 15 | | state and shall be relinquished to the department or an agent of the |
|---|
| 16 | 16 | | department on demand or otherwise disposed of in a manner |
|---|
| 17 | 17 | | prescribed by the department. |

| 18 | 18 | | SECTION 2. The heading to Section 43.3561, Agriculture |
|---|
| 19 | 19 | | Code, is amended to read as follows: |
|---|
| 20 | 20 | | Sec. 43.3561. IDENTIFICATION OF BREEDER DEER; TITLE FOR |
|---|
| 21 | 21 | | CERTAIN PURPOSES. |
|---|
| 22 | 22 | | SECTION 3. Section 43.3561, Parks and Wildlife Code, is |
|---|
| 23 | 23 | | amended by adding Subsections (d), (e), and (f) to read as follows: |
|---|
| 24 | 24 | | (d) The deer breeder holding a breeder deer under a deer |
|---|
| 25 | 25 | | breeder's permit issued by the department under this subchapter has |
|---|
| 26 | 26 | | title to the deer only for the following purposes: |
|---|
| 27 | 27 | | (1) to participate in an indemnity program offered by |
|---|
| 28 | 28 | | the United States Department of Agriculture; and |
|---|
| 29 | 29 | | (2) to allow for the passage of title to the deer on |
|---|
| 30 | 30 | | the death of the deer breeder or on the sale, transfer, barter, or |
|---|
| 31 | 31 | | exchange of a breeder deer. |
|---|
| 32 | 32 | | (e) The tag or any written or photocopied document of any |
|---|
| 33 | 33 | | nature containing the alphanumeric number described by Subsection |
|---|
| 34 | 34 | | (a) may serve as proof of title to a breeder deer for purposes of |
|---|
| 35 | 35 | | Subsection (d). |
|---|
| 36 | 36 | | (f) Subsection (d) does not alter the authority of the |
|---|
| 37 | 37 | | department over breeder deer. |
|---|
| 38 | 38 | | SECTION 4. This Act takes effect September 1, 2009. |
