55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to proof of title to breeding deer for certain purposes of
88 deer breeding operations.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subsection (a), Section 43.024, Parks and
1111 Wildlife Code, is amended to read as follows:
1212 (a) Except as provided by Subchapter L, all [All] protected
1313 wildlife collected and subsequently held under this subchapter or
1414 rules adopted under this subchapter remain the property of the
1515 state and shall be relinquished to the department or an agent of the
1616 department on demand or otherwise disposed of in a manner
1717 prescribed by the department.
1818 SECTION 2. The heading to Section 43.3561, Agriculture
1919 Code, is amended to read as follows:
2020 Sec. 43.3561. IDENTIFICATION OF BREEDER DEER; TITLE FOR
2121 CERTAIN PURPOSES.
2222 SECTION 3. Section 43.3561, Parks and Wildlife Code, is
2323 amended by adding Subsections (d), (e), and (f) to read as follows:
2424 (d) The deer breeder holding a breeder deer under a deer
2525 breeder's permit issued by the department under this subchapter has
2626 title to the deer only for the following purposes:
2727 (1) to participate in an indemnity program offered by
2828 the United States Department of Agriculture; and
2929 (2) to allow for the passage of title to the deer on
3030 the death of the deer breeder or on the sale, transfer, barter, or
3131 exchange of a breeder deer.
3232 (e) The tag or any written or photocopied document of any
3333 nature containing the alphanumeric number described by Subsection
3434 (a) may serve as proof of title to a breeder deer for purposes of
3535 Subsection (d).
3636 (f) Subsection (d) does not alter the authority of the
3737 department over breeder deer.
3838 SECTION 4. This Act takes effect September 1, 2009.
