 A BILL TO BE ENTITLED
 AN ACT
 relating to proof of title to breeding deer for certain purposes of
 deer breeding operations.
 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 SECTION 1. Subsection (a), Section 43.024, Parks and
 Wildlife Code, is amended to read as follows:
 (a) Except as provided by Subchapter L, all [All] protected
 wildlife collected and subsequently held under this subchapter or
 rules adopted under this subchapter remain the property of the
 state and shall be relinquished to the department or an agent of the
 department on demand or otherwise disposed of in a manner
 prescribed by the department.
 SECTION 2. The heading to Section 43.3561, Agriculture
 Code, is amended to read as follows:
 Sec. 43.3561. IDENTIFICATION OF BREEDER DEER; TITLE FOR
 CERTAIN PURPOSES.
 SECTION 3. Section 43.3561, Parks and Wildlife Code, is
 amended by adding Subsections (d), (e), and (f) to read as follows:
 (d)  The deer breeder holding a breeder deer under a deer
 breeder's permit issued by the department under this subchapter has
 title to the deer only for the following purposes:
 (1)  to participate in an indemnity program offered by
 the United States Department of Agriculture; and
 (2)  to allow for the passage of title to the deer on
 the death of the deer breeder or on the sale, transfer, barter, or
 exchange of a breeder deer.
 (e)  The tag or any written or photocopied document of any
 nature containing the alphanumeric number described by Subsection
 (a) may serve as proof of title to a breeder deer for purposes of
 Subsection (d).
 (f)  Subsection (d) does not alter the authority of the
 department over breeder deer.
 SECTION 4. This Act takes effect September 1, 2009.
