7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

8 | 8 | | SECTION 1. Chapter 32, Education Code, is amended by adding |
---|
9 | 9 | | Subchapter H to read as follows: |
---|
10 | 10 | | SUBCHAPTER H. COMPUTER LENDING PILOT PROGRAM |
---|
11 | 11 | | Sec. 32.351. ESTABLISHMENT OF PILOT PROGRAM. The |
---|
12 | 12 | | commissioner by rule shall establish a computer lending pilot |
---|
13 | 13 | | program to provide computers to participating public schools that |
---|
14 | 14 | | make computers available for use by students and their parents. |
---|
15 | 15 | | Sec. 32.352. PILOT PROGRAM ADMINISTRATION. The |
---|
16 | 16 | | commissioner shall establish procedures for the administration of |
---|
17 | 17 | | the pilot program, including procedures for distributing to |
---|
18 | 18 | | participating public schools: |
---|
19 | 19 | | (1) any surplus or salvage data processing equipment |
---|
20 | 20 | | available for distribution under the pilot program; or |
---|
21 | 21 | | (2) computers donated or purchased for that purpose |
---|
22 | 22 | | with funds from any available source, including a foundation, |
---|
23 | 23 | | private entity, governmental entity, and institution of higher |
---|
24 | 24 | | education. |
---|
25 | 25 | | Sec. 32.353. ELIGIBLE SCHOOLS. A public school is eligible |
---|
26 | 26 | | to participate in the pilot program if: |
---|
27 | 27 | | (1) 50 percent or more of the students enrolled in the |
---|
28 | 28 | | school are educationally disadvantaged; and |
---|
29 | 29 | | (2) the school operates or agrees to operate a |
---|
30 | 30 | | computer lending program that: |
---|
31 | 31 | | (A) allows students and parents to borrow a |
---|
32 | 32 | | computer; |
---|
33 | 33 | | (B) includes an option for students and parents |
---|
34 | 34 | | to work toward owning a computer initially borrowed under the |
---|
35 | 35 | | school's lending program, subject to any applicable legal |
---|
36 | 36 | | restrictions regarding disposition of the computer involved; |
---|
37 | 37 | | (C) provides computer training for students and |
---|
38 | 38 | | parents; and |
---|
39 | 39 | | (D) operates outside regular school hours, |
---|
40 | 40 | | including operation until at least 7 p.m. on at least three days |
---|
41 | 41 | | each week. |
---|
42 | 42 | | Sec. 32.354. ANNUAL REPORT. Not later than January 1 of |
---|
43 | 43 | | each year, the commissioner shall submit a report to the |
---|
44 | 44 | | legislature regarding the computer lending pilot program |
---|
45 | 45 | | established under this subchapter. |
---|
46 | 46 | | Sec. 32.355. EXPIRATION. This subchapter expires September |
---|
47 | 47 | | 1, 2014. |
---|
48 | 48 | | SECTION 2. Section 2175.128, Government Code, is amended by |
---|
49 | 49 | | adding Subsections (a-1) and (b-1) to read as follows: |
---|
50 | 50 | | (a-1) Notwithstanding Subsection (a), if a disposition of a |
---|
51 | 51 | | state agency's surplus or salvage data processing equipment is not |
---|
52 | 52 | | made under Section 2175.125 or 2175.184, the state agency shall |
---|
53 | 53 | | make the equipment available to the commissioner of education for |
---|
54 | 54 | | use in the computer lending pilot program established under |
---|
55 | 55 | | Subchapter H, Chapter 32, Education Code. If the commissioner of |
---|
56 | 56 | | education declines to take the equipment, the state agency shall |
---|
57 | 57 | | transfer the equipment in accordance with Subsection (a). The |
---|
58 | 58 | | state agency may not collect a fee or other reimbursement from the |
---|
59 | 59 | | commissioner of education for the equipment made available under |
---|
60 | 60 | | this subsection. This subsection expires September 1, 2014. |
---|
61 | 61 | | (b-1) Notwithstanding Subsection (b), if a disposition of |
---|
62 | 62 | | the surplus or salvage data processing equipment of a state |
---|
63 | 63 | | eleemosynary institution or an institution or agency of higher |
---|
64 | 64 | | education is not made under other law, the institution or agency |
---|
65 | 65 | | shall make the equipment available to the commissioner of education |
---|
66 | 66 | | for use in the computer lending pilot program established under |
---|
67 | 67 | | Subchapter H, Chapter 32, Education Code. If the commissioner of |
---|
68 | 68 | | education declines to take the equipment, the institution or agency |
---|
69 | 69 | | shall transfer the equipment in accordance with Subsection (b). |
---|
70 | 70 | | The state eleemosynary institution or institution or agency of |
---|
71 | 71 | | higher education may not collect a fee or other reimbursement from |
---|
72 | 72 | | the commissioner of education for the equipment made available |
---|
73 | 73 | | under this subsection. This subsection expires September 1, 2014. |
---|
74 | 74 | | SECTION 3. This Act takes effect September 1, 2009. |
