77 relating to retirement qualifications for appellate judges.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 839.102, Government Code, is amended by
1010 amending Subsection (f) and adding Subsection (g) to read as
1111 follows:
1212 (f) The service retirement annuity of a member qualifying
1313 for retirement under Section 839.101(a)(4) is the applicable state
1414 salary under Subsection (a) multiplied by a percentage amount that
1515 is the sum of 50 percent plus the product of 2.3 percent multiplied
1616 by the number of years of prior service credit under Subsection (g)
1717 and subsequent service credit the member accrues under Section
1818 840.1027. After including any increase under Subsection (b), the
1919 service retirement annuity under this subsection may not be an
2020 amount that is greater than 90 percent of the applicable salary
2121 under Subsection (a).
2222 (g) For purposes of Subsection (f), a member's prior service
2323 credit is the amount of service credit that the member earned in the
2424 retirement system prior to serving on an appellate court that is in
2525 excess of the amount of service credit that the member requires to
2626 be eligible to retire and receive a service retirement annuity
2727 under Section 839.101(a)(4).
2828 SECTION 2. The change in law made by this Act applies only
2929 to a person who retires on or after the effective date of this Act.
3030 The change in law does not apply to a person who retired before the
3131 effective date of this Act.
3232 SECTION 3. This Act takes effect September 1, 2009.
