7 | 7 | | education for certain credit hours that do not count toward a |

8 | 8 | | degree. |

9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Subsection (d), Section 61.0595, Education Code, |
---|
11 | 11 | | is amended to read as follows: |
---|
12 | 12 | | (d) The following are not counted for purposes of |
---|
13 | 13 | | determining whether the student has previously earned the number of |
---|
14 | 14 | | semester credit hours specified by Subsection (a): |
---|
15 | 15 | | (1) semester credit hours earned by the student before |
---|
16 | 16 | | receiving a baccalaureate degree that has previously been awarded |
---|
17 | 17 | | to the student; |
---|
18 | 18 | | (2) semester credit hours earned by the student by |
---|
19 | 19 | | examination or under any other procedure by which credit is earned |
---|
20 | 20 | | without registering for a course for which tuition is charged; |
---|
21 | 21 | | (3) credit for a remedial education course, a |
---|
22 | 22 | | technical course, a workforce education course funded according to |
---|
23 | 23 | | contact hours, or another course that does not count toward a degree |
---|
24 | 24 | | program at the institution; [and] |
---|
25 | 25 | | (4) semester credit hours earned by the student at a |
---|
26 | 26 | | private institution or an out-of-state institution; and |
---|
27 | 27 | | (5) in addition to semester credit hours excluded |
---|
28 | 28 | | under another provision of this subsection, not more than 30 |
---|
29 | 29 | | semester credit hours earned through one or more dual credit |
---|
30 | 30 | | courses for which the student received credit toward a high school |
---|
31 | 31 | | diploma, if those courses are identified by the board as |
---|
32 | 32 | | lower-division courses appropriate for general academic transfer |
---|
33 | 33 | | between institutions of higher education. |
---|
34 | 34 | | SECTION 2. The change in law made by this Act to Section |
---|
35 | 35 | | 61.0595, Education Code, applies beginning with the funding |
---|
36 | 36 | | recommendations made under Section 61.059, Education Code, for the |
---|
37 | 37 | | 2011-2012 academic year. |
---|
38 | 38 | | SECTION 3. This Act takes effect immediately if it receives |
---|
39 | 39 | | a vote of two-thirds of all the members elected to each house, as |
---|
40 | 40 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
41 | 41 | | Act does not receive the vote necessary for immediate effect, this |
---|
42 | 42 | | Act takes effect September 1, 2009. |
