55 AN ACT
66 relating to the formula funding for public institutions of higher
77 education for certain credit hours that do not count toward a
88 degree.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subsection (d), Section 61.0595, Education Code,
1111 is amended to read as follows:
1212 (d) The following are not counted for purposes of
1313 determining whether the student has previously earned the number of
1414 semester credit hours specified by Subsection (a):
1515 (1) semester credit hours earned by the student before
1616 receiving a baccalaureate degree that has previously been awarded
1717 to the student;
1818 (2) semester credit hours earned by the student by
1919 examination or under any other procedure by which credit is earned
2020 without registering for a course for which tuition is charged;
2121 (3) credit for a remedial education course, a
2222 technical course, a workforce education course funded according to
2323 contact hours, or another course that does not count toward a degree
2424 program at the institution; [and]
2525 (4) semester credit hours earned by the student at a
2626 private institution or an out-of-state institution; and
2727 (5) in addition to semester credit hours excluded
2828 under another provision of this subsection, not more than 30
2929 semester credit hours earned through one or more dual credit
3030 courses for which the student received credit toward a high school
3131 diploma, if those courses are identified by the board as
3232 lower-division courses appropriate for general academic transfer
3333 between institutions of higher education.
3434 SECTION 2. The change in law made by this Act to Section
3535 61.0595, Education Code, applies beginning with the funding
3636 recommendations made under Section 61.059, Education Code, for the
3737 2011-2012 academic year.
3838 SECTION 3. This Act takes effect immediately if it receives
3939 a vote of two-thirds of all the members elected to each house, as
4040 provided by Section 39, Article III, Texas Constitution. If this
4141 Act does not receive the vote necessary for immediate effect, this
4242 Act takes effect September 1, 2009.
