88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 29.098, Education Code, is amended to
1010 read as follows:
1111 Sec. 29.098. INTENSIVE SUMMER PROGRAMS. (a) In this
1212 section, "pilot program" means the intensive summer pilot program
1313 for students identified as being at risk of dropping out of school
1414 or college.
1515 (b) The [From funds appropriated for that purpose, the]
1616 commissioner [of education and the commissioner of higher education
1717 by rule] shall establish a pilot program to award grants to
1818 participating campuses to provide intensive academic instruction
1919 during the period in which school is recessed for the summer
2020 [semester] to promote college and workforce readiness to students
2121 identified as being at risk of dropping out of school, as defined by
2222 Section 29.081 [or college]. A grant awarded under this section may
2323 be used to fund any of the following categories of programs:
2424 (1) [a program administered by an institution of
2525 higher education to provide intensive academic instruction in
2626 English language arts, mathematics, and science to facilitate the
2727 student's transition from high school to a postsecondary
2828 institution;
2929 [(2)] a program administered by a school district in
3030 partnership with an institution of higher education to provide
3131 intensive academic instruction in English language arts,
3232 mathematics, and science to promote high school completion and
3333 college readiness; and
3434 (2) [(3)] a program administered by a school district
3535 in partnership with an institution of higher education to provide
3636 intensive academic instruction in reading and mathematics to
3737 students in grades six through eight to promote high school
3838 completion and college readiness.
3939 (c) The commissioner [of education] may select for
4040 participation in the pilot program only a campus that is eligible
4141 under the criteria established under Section 39.358.
4242 (d) [A grant may be awarded to an institution of higher
4343 education for a program administered under Subsection (b)(1) only
4444 if at least 50 percent of the students served in the program:
4545 [(1) have a score on the Scholastic Assessment Test
4646 (SAT) or American College Test (ACT) that is equal to a score less
4747 than the national mean score;
4848 [(2) have been awarded a grant under the federal Pell
4949 grant program;
5050 [(3) are at least 20 years of age on the date the
5151 student initially enrolls in the institution of higher education;
5252 or
5353 [(4) have enrolled or will initially enroll as a
5454 part-time student.
5555 [(e) A program supported by a grant to provide intensive
5656 summer instruction under this section must:
5757 [(1) provide rigorous academic instruction;
5858 [(2) provide at least four weeks of instruction; and
5959 [(3) for a program described by Subsection (b)(2) or
6060 (3), be designed and implemented in partnership with an institution
6161 of higher education.
6262 [(f) To the extent practicable, an institution of higher
6363 education shall create work-study opportunities for students
6464 enrolled in teacher preparation programs to assist in providing
6565 instruction in programs described by this section.
6666 [(g)] A grant awarded under this section:
6767 (1) may not exceed $750 for each participating
6868 student; and
6969 (2) must be matched by not less than $250 for each
7070 participating student in other federal, state, or local funds,
7171 including private donations.
7272 (e) [(h)] For purposes of Subsection (d)(2) [(g)(2)], a
7373 school district is encouraged to use funds allocated under Section
7474 42.2516(b)(3).
7575 (f) [(i)] A grant awarded under this section may not be used
7676 to replace federal, state, or local funds previously spent on a
7777 summer intensive program, but may be used to expand an existing
7878 program.
7979 (g) [(j)] The entire amount of a grant awarded under this
8080 section:
8181 (1) must fund the program described in the application
8282 for the grant; and
8383 (2) may be used for:
8484 (A) instructional materials;
8585 (B) technology used primarily for the delivery of
8686 supplementary instruction;
8787 (C) teacher training and professional
8888 development, including educator stipends; and
8989 (D) other necessary costs, as determined by the
9090 commissioner [of education].
9191 (h) [(k)] Instructional materials adopted by the State
9292 Board of Education shall be used for instruction in a program under
9393 this section [Subsection (b)(2) or (3)]. The State Board of
9494 Education may adopt any additional instructional materials as
9595 necessary for a program under this section [Subsection (b)(2) or
9696 (3). The Texas Higher Education Coordinating Board may adopt
9797 instructional materials as necessary for students enrolled in a
9898 program under Subsection (b)(1)].
9999 (i) [(l)] The State Board of Education [and the Texas Higher
100100 Education Coordinating Board] shall include information technology
101101 instructional resources that incorporate established best
102102 practices for instruction among approved instructional materials
103103 for intensive summer programs under this section to enhance the
104104 effectiveness of the programs.
105105 SECTION 2. Section 61.0762, Education Code, is amended to
106106 read as follows:
107107 Sec. 61.0762. PROGRAMS TO ENHANCE STUDENT SUCCESS. (a) To
108108 implement the college readiness and success strategic action plan
109109 adopted under Section 61.0761 and to enhance the success of
110110 students at institutions of higher education, the board by rule
111111 shall [develop]:
112112 (1) develop [summer] higher education bridge programs
113113 in the subject areas of mathematics, science, social science, or
114114 [and] English language arts to increase student success by reducing
115115 the need for developmental education;
116116 (2) develop incentive programs for institutions of
117117 higher education that implement research-based, innovative
118118 developmental education initiatives;
119119 (3) develop a pilot program to award grants to
120120 institutions of higher education for intensive programs designed to
121121 address the needs of students at risk of dropping out of college
122122 [financial assistance programs for educationally disadvantaged
123123 students, as defined by Section 5.001, who take college entrance
124124 and college readiness assessment instruments];
125125 (4) develop professional development programs for
126126 faculty of institutions of higher education on college readiness
127127 standards and the implications of such standards on instruction;
128128 and
129129 (5) develop other programs as determined by the board
130130 that support the participation and success goals in "Closing the
131131 Gaps," the state's master plan for higher education.
132132 (b) The board may award a grant under Subsection (a)(3) to
133133 an institution of higher education only if at least 50 percent of
134134 the students served in the program:
135135 (1) have a score on the Scholastic Assessment Test
136136 (SAT) or American College Test (ACT) that is less than the national
137137 mean score for that test;
138138 (2) have been awarded a grant under the federal Pell
139139 grant program;
140140 (3) are at least 20 years of age on the date the
141141 student enrolls as a first-time freshman in the institution of
142142 higher education;
143143 (4) have enrolled or will initially enroll as a
144144 part-time student; or
145145 (5) meet any other requirements established by the
146146 board.
147147 SECTION 3. Section 39.363, Education Code, is amended to
148148 read as follows:
149149 Sec. 39.363. FUNDING FOR CERTAIN PROGRAMS. (a) From funds
150150 appropriated, the Texas Higher Education Coordinating Board shall
151151 allocate $8.75 million each year to establish mathematics, science,
152152 and technology teacher preparation academies under Section 21.462,
153153 provide funding to the commissioner of education to [and] implement
154154 and administer the program under Section 29.098, and award grants
155155 under Section 61.0762(a)(3).
156156 (b) The Texas Higher Education Coordinating Board shall
157157 establish mathematics, science, and technology teacher preparation
158158 academies under Section 21.462, provide funding to the commissioner
159159 of education to [and] implement and administer the program under
160160 Section 29.098, and award grants under Section 61.0762(a)(3) in a
161161 manner consistent with the goals of this subchapter and the goals in
162162 "Closing the Gaps," the state's master plan for higher education.
163163 SECTION 4. This Act takes effect immediately if it receives
164164 a vote of two-thirds of all the members elected to each house, as
165165 provided by Section 39, Article III, Texas Constitution. If this
166166 Act does not receive the vote necessary for immediate effect, this
167167 Act takes effect September 1, 2009.
