| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Subchapter E, Chapter 2306, Government Code, is |
|---|
| 12 | 12 | | amended by adding Section 2306.096 to read as follows: |
|---|
| 13 | 13 | | Sec. 2306.096. COMMUNITY DEVELOPMENT CORPORATION PILOT |
|---|
| 14 | 14 | | PROGRAM. (a) In this section, "community development corporation" |
|---|
| 15 | 15 | | means a private, nonprofit corporation organized to foster economic |
|---|
| 16 | 16 | | growth and revitalization, create small businesses, or develop |
|---|
| 17 | 17 | | affordable housing in a defined neighborhood or for a targeted |
|---|
| 18 | 18 | | population. |
|---|
| 19 | 19 | | (b) Using existing resources, the department shall |
|---|
| 20 | 20 | | establish a pilot program to create and provide support for a |
|---|
| 21 | 21 | | regional community development corporation in a single rural area |
|---|
| 22 | 22 | | of this state. |
|---|
| 23 | 23 | | (c) Not later than January 1, 2011, the department shall |
|---|
| 24 | 24 | | report to the governor, the lieutenant governor, the speaker of the |
|---|
| 25 | 25 | | house of representatives, and the members of the legislature |
|---|
| 26 | 26 | | regarding: |
|---|
| 27 | 27 | | (1) the impact of the pilot program in the rural area |
|---|
| 28 | 28 | | in which it was implemented; and |
|---|
| 29 | 29 | | (2) the feasibility and advisability of creating and |
|---|
| 30 | 30 | | supporting additional regional community development corporations |
|---|
| 31 | 31 | | to serve other areas of the state. |
|---|
| 32 | 32 | | (d) This section expires October 1, 2011. |
|---|
| 33 | 33 | | SECTION 2. Subchapter LL, Chapter 2306, Government Code, is |
|---|
| 34 | 34 | | amended by adding Section 2306.934 to read as follows: |
|---|
| 35 | 35 | | Sec. 2306.934. COMMUNITY DEVELOPMENT CORPORATION FOR |
|---|
| 36 | 36 | | MIGRANT LABOR HOUSING FACILITIES. (a) In this section, "community |
|---|
| 37 | 37 | | development corporation" means a private, nonprofit corporation |
|---|
| 38 | 38 | | organized to foster economic growth and revitalization, create |
|---|
| 39 | 39 | | small businesses, or develop affordable housing in a defined |
|---|
| 40 | 40 | | neighborhood or for a targeted population. |
|---|
| 41 | 41 | | (b) Using existing resources, the department shall create a |
|---|
| 42 | 42 | | statewide community development corporation charged with |
|---|
| 43 | 43 | | developing, acquiring, and rehabilitating migrant labor housing |
|---|
| 44 | 44 | | facilities in appropriate areas in the state. |
|---|
| 45 | 45 | | (c) The department shall work with the community |
|---|
| 46 | 46 | | development corporation to implement the findings and |
|---|
| 47 | 47 | | recommendations of the department in the report submitted under |
|---|
| 48 | 48 | | Section 2(f), Chapter 60 (H.B. 1099), Acts of the 79th Legislature, |
|---|
| 49 | 49 | | Regular Session, 2005. |
|---|
| 50 | 50 | | SECTION 3. The Texas Department of Housing and Community |
|---|
| 51 | 51 | | Affairs shall create the community development corporations |
|---|
| 52 | 52 | | required by this Act as soon as practicable after the effective date |
|---|
| 53 | 53 | | of this Act, but not later than October 1, 2009. |
|---|
| 54 | 54 | | SECTION 4. This Act takes effect immediately if it receives |
|---|
| 55 | 55 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 56 | 56 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 57 | 57 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 58 | 58 | | Act takes effect September 1, 2009. |
