| 9 | 9 | SECTION 1. Amend Section 223.041 of the Transportation Code | |
| 10 | 10 | by adding Subsections (c) and (d) to read as follows: | |
| 11 | 11 | (c) The Department may not contract with a private sector | |
| 12 | 12 | provider whose ratio of licensed professional engineers to value of | |
| 13 | 13 | work performed on a biennual basis exceeds that of the Department. | |
| 14 | 14 | (d) The Department may not contract with a private sector | |
| 15 | 15 | provider whose annual compensation for licensed professional | |
| 16 | 16 | engineers, on average, exceeds the average annual compensation of | |
| 17 | 17 | licensed professional engineers who are employed by the Department. | |
| 18 | 18 | SECTION 2. This Act takes effect immediately if it receives | |
| 19 | 19 | a vote of two-thirds of all the members elected to each house, as | |
| 20 | 20 | provided by Section 39, Article III, Texas Constitution. If this | |
| 21 | 21 | Act does not receive the vote necessary for immediate effect, this | |
| 22 | 22 | Act takes effect September 1, 2009. |
