A BILL TO BE ENTITLED
AN ACT
relating to engineering and design contracts for the Texas
Department of Transportation.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Amend Section 223.041 of the Transportation Code
by adding Subsections (c) and (d) to read as follows:
(c) The Department may not contract with a private sector
provider whose ratio of licensed professional engineers to value of
work performed on a biennual basis exceeds that of the Department.
(d) The Department may not contract with a private sector
provider whose annual compensation for licensed professional
engineers, on average, exceeds the average annual compensation of
licensed professional engineers who are employed by the Department.
SECTION 2. This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution. If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2009.
