66 relating to optional fees on the registration of a vehicle imposed
77 by certain counties.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Subsections (a), (f), and (g), Section 502.1725,
1010 Transportation Code, are amended to read as follows:
1111 (a) This section applies only to a county:
1212 (1) that borders the United Mexican States;
1313 (2) that has a population of more than 300,000; and
1414 (3) that either:
1515 (A) has no [in which the largest] municipality
1616 with [has] a population of [less than] 300,000 or more; or
1717 (B) borders another state of the United States.
1818 (f) The county assessor-collector of a county imposing a fee
1919 under this section shall collect the additional fee for a vehicle
2020 when other fees imposed under this chapter are collected. The
2121 county shall deposit [send] the fee revenue in a special account in
2222 the county general fund. Money in the account may be used only to
2323 fund the costs of constructing and maintaining public roadway
2424 projects in the county and acquiring rights-of-way for those
2525 projects. The county may enter into a contract for a project with a
2626 public entity authorized by law to construct public roadway
2727 projects in [to the regional mobility authority of the county to
2828 fund long-term transportation projects in] the county.
2929 (g) The department shall collect the additional fee on a
3030 vehicle that is owned by a resident of a county imposing a fee under
3131 this section and that, under this chapter, must be registered
3232 directly with the department. The department shall send all fees
3333 collected for a county under this subsection to the county for
3434 deposit and use as provided by Subsection (f) [regional mobility
3535 authority of the county to fund long-term transportation projects
3636 in the county].
3737 SECTION 2. This Act takes effect immediately if it receives
3838 a vote of two-thirds of all the members elected to each house, as
3939 provided by Section 39, Article III, Texas Constitution. If this
4040 Act does not receive the vote necessary for immediate effect, this
4141 Act takes effect September 1, 2009.
