| 6 | 6 | | relating to optional fees on the registration of a vehicle imposed |
|---|
| 7 | 7 | | by certain counties. |
|---|
| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Subsections (a), (f), and (g), Section 502.1725, |
|---|
| 10 | 10 | | Transportation Code, are amended to read as follows: |
|---|
| 11 | 11 | | (a) This section applies only to a county: |
|---|
| 12 | 12 | | (1) that borders the United Mexican States; |
|---|
| 13 | 13 | | (2) that has a population of more than 300,000; and |
|---|
| 14 | 14 | | (3) that either: |
|---|
| 15 | 15 | | (A) has no [in which the largest] municipality |
|---|
| 16 | 16 | | with [has] a population of [less than] 300,000 or more; or |
|---|
| 17 | 17 | | (B) borders another state of the United States. |
|---|
| 18 | 18 | | (f) The county assessor-collector of a county imposing a fee |
|---|
| 19 | 19 | | under this section shall collect the additional fee for a vehicle |
|---|
| 20 | 20 | | when other fees imposed under this chapter are collected. The |
|---|
| 21 | 21 | | county shall deposit [send] the fee revenue in a special account in |
|---|
| 22 | 22 | | the county general fund. Money in the account may be used only to |
|---|
| 23 | 23 | | fund the costs of constructing and maintaining public roadway |
|---|
| 24 | 24 | | projects in the county and acquiring rights-of-way for those |
|---|
| 25 | 25 | | projects. The county may enter into a contract for a project with a |
|---|
| 26 | 26 | | public entity authorized by law to construct public roadway |
|---|
| 27 | 27 | | projects in [to the regional mobility authority of the county to |
|---|
| 28 | 28 | | fund long-term transportation projects in] the county. |
|---|
| 29 | 29 | | (g) The department shall collect the additional fee on a |
|---|
| 30 | 30 | | vehicle that is owned by a resident of a county imposing a fee under |
|---|
| 31 | 31 | | this section and that, under this chapter, must be registered |
|---|
| 32 | 32 | | directly with the department. The department shall send all fees |
|---|
| 33 | 33 | | collected for a county under this subsection to the county for |
|---|
| 34 | 34 | | deposit and use as provided by Subsection (f) [regional mobility |
|---|
| 35 | 35 | | authority of the county to fund long-term transportation projects |
|---|
| 36 | 36 | | in the county]. |
|---|
| 37 | 37 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 38 | 38 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 39 | 39 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 40 | 40 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 41 | 41 | | Act takes effect September 1, 2009. |
