55 relating to the powers and duties of the Lake View Management and
66 Development District; providing authority to impose a tax and issue
77 bonds; granting certain powers relating to navigation
88 improvements; and granting powers of a road district.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 3828.053, Special District Local Laws
1111 Code, is amended to read as follows:
1212 Sec. 3828.053. VACANCY. (a) The remaining directors shall
1313 fill a vacancy on the board by appointing a person who meets the
1414 qualifications prescribed by Section 3828.052.
1515 (b) If there are fewer than three directors, on petition by
1616 the owner or owners of a majority of the assessed value of the real
1717 property in the district according to the most recent certified tax
1818 appraisal roll for Henderson County, the Commissioners Court of
1919 Henderson County shall appoint the necessary number of directors to
2020 fill all board vacancies.
2121 SECTION 2. Subchapter B, Chapter 3828, Special District
2222 Local Laws Code, is amended by adding Section 3828.0535 to read as
2323 follows:
2424 Sec. 3828.0535. VOTING REQUIREMENT. A concurrence of a
2525 majority of the total membership of the board is sufficient for
2626 transacting any business of the district.
2727 SECTION 3. Section 3828.055, Special District Local Laws
2828 Code, is amended to read as follows:
2929 Sec. 3828.055. OFFICERS. The board shall elect from among
3030 the directors a presiding officer, a vice presiding officer, [and]
3131 a secretary, and any other officers the board considers necessary.
3232 SECTION 4. Section 3828.101, Special District Local Laws
3333 Code, is amended to read as follows:
3434 Sec. 3828.101. GENERAL POWERS AND DUTIES. The district has
3535 the powers and duties provided by:
3636 (1) the general laws relating to conservation and
3737 reclamation districts created under Section 59, Article XVI, Texas
3838 Constitution, including Chapters 49 and 54, Water Code, except that
3939 the district's bonds and other securities are not subject to the
4040 jurisdiction or supervision of the commission under Chapter 49,
4141 Water Code, or other law;
4242 (2) the general laws relating to road districts and
4343 road utility districts created under Section 52(b), Article III,
4444 Texas Constitution, including Chapters 257 and [Chapter] 441,
4545 Transportation Code;
4646 (3) Chapter 372, Local Government Code, in the same
4747 manner as a municipality or a county;
4848 (4) Chapter 375, Local Government Code; and
4949 (5) Chapter 505, Local Government Code.
5050 SECTION 5. Section 3828.102, Special District Local Laws
5151 Code, is amended to read as follows:
5252 Sec. 3828.102. IMPROVEMENT PROJECTS. The district may
5353 provide, or it may enter into contracts with a governmental or
5454 private entity to provide, the following types of improvement
5555 projects or activities in support of or incidental to those
5656 projects:
5757 (1) a retail or wholesale water treatment, supply, and
5858 distribution facility or system to provide potable and nonpotable
5959 water to the residents and businesses of the district, including a
6060 wastewater and sewerage collection and treatment facility or
6161 system, provided that treated effluent water resulting from a
6262 sewerage treatment facility operated by or in the district may be
6363 used by the district for irrigation in the district;
6464 (2) septic tank maintenance services inside or outside
6565 the district and solid waste disposal services if the board
6666 determines the action to be necessary and appropriate to protect
6767 the district;
6868 (3) a macadamized, graveled, or paved road, street, or
6969 turnpike, inside and outside the district to the extent authorized
7070 by Section 52, Article III, Texas Constitution;
7171 (4) the planning, design, construction, improvement,
7272 and maintenance of:
7373 (A) landscaping;
7474 (B) highway right-of-way or transit corridor
7575 beautification and improvement;
7676 (C) lighting, banners, and signs;
7777 (D) a street or sidewalk;
7878 (E) a hiking and cycling path or trail;
7979 (F) a pedestrian walkway, skywalk, crosswalk, or
8080 tunnel;
8181 (G) a park, lake, garden, recreational facility,
8282 sports facility, open space, scenic area, or related exhibit or
8383 preserve;
8484 (H) a fountain, plaza, or pedestrian mall; or
8585 (I) a drainage or storm-water detention
8686 improvement;
8787 (5) protection and improvement of the quality of storm
8888 water that flows through the district;
8989 (6) the planning, design, construction, improvement,
9090 maintenance, and operation of:
9191 (A) a solid waste, water, sewer, or power
9292 facility or service, including an electrical, gas, steam, or
9393 chilled water facility; or
9494 (B) an off-street parking facility or heliport;
9595 (7) the planning and acquisition of:
9696 (A) public art and sculpture and related exhibits
9797 and facilities; or
9898 (B) an educational and cultural exhibit or
9999 facility;
100100 (8) the planning, design, construction, acquisition,
101101 lease, rental, improvement, maintenance, installation, and
102102 management of and provision of furnishings for a facility for:
103103 (A) a conference, convention, or exhibition;
104104 (B) a manufacturer, consumer, or trade show;
105105 (C) a civic, community, or institutional event;
106106 or
107107 (D) an exhibit, display, attraction, special
108108 event, or seasonal or cultural celebration or holiday;
109109 (9) the removal, razing, demolition, or clearing of
110110 land or improvements in connection with an improvement project;
111111 (10) the acquisition and improvement of land or other
112112 property for the mitigation of the environmental effects of an
113113 improvement project;
114114 (11) the acquisition of property or an interest in
115115 property in connection with an authorized improvement project;
116116 (12) a special or supplemental service for the
117117 improvement and promotion of the district or an area adjacent to the
118118 district or for the protection of public health and safety in or
119119 adjacent to the district, including:
120120 (A) advertising;
121121 (B) promotion;
122122 (C) tourism;
123123 (D) health and sanitation;
124124 (E) public safety;
125125 (F) security;
126126 (G) fire protection or emergency medical
127127 services;
128128 (H) business recruitment;
129129 (I) development;
130130 (J) elimination of traffic congestion; and
131131 (K) recreational, educational, or cultural
132132 improvements, enhancements, and services; [or]
133133 (13) a canal, waterway, bulkhead, or dock, inside or
134134 outside the district's boundaries, that is necessary to, incidental
135135 to, or in aid of the navigation of inland water;
136136 (14) a floodplain or wetlands regulation project,
137137 including the acquisition of necessary local, state, or federal
138138 permits; or
139139 (15) any similar public improvement, facility, or
140140 service.
141141 SECTION 6. Section 3828.151, Special District Local Laws
142142 Code, is amended to read as follows:
143143 Sec. 3828.151. GENERAL POWERS REGARDING FINANCIAL MATTERS.
144144 The district may:
145145 (1) impose an ad valorem tax [in accordance with
146146 Chapter 375, Local Government Code,] on all taxable property in the
147147 district;
148148 (2) impose an assessment or impact fee in the manner
149149 provided for a municipality or county under Chapter 372, Local
150150 Government Code, on all industrial, commercial, and residential
151151 property in the district;
152152 (3) impose and apply the proceeds from a sales and use
153153 tax, and a hotel occupancy tax, as authorized by this chapter;
154154 (4) impose a rate, fee, or charge for the use of an
155155 improvement project or the consumption of a product resulting from
156156 an improvement project;
157157 (5) borrow money for a district purpose by issuing or
158158 executing bonds, notes, credit agreements, or other obligations of
159159 any kind found by the board to be necessary or appropriate for the
160160 district purpose;
161161 (6) establish, revise, repeal, enforce, collect, and
162162 apply the proceeds from a user fee or charge for the enjoyment,
163163 sale, rental, or other use of a district facility, service,
164164 property, or improvement project;
165165 (7) provide or secure the payment or repayment of the
166166 costs and expenses of the establishment, administration, and
167167 operation of the district and the district's costs or share of the
168168 costs of an improvement project or district contractual obligation
169169 or indebtedness by or through a lease, installment purchase
170170 contract, or other agreement with any person, or the imposition of
171171 taxes, user fees, concessions, rentals, or other revenues or
172172 resources of the district;
173173 (8) establish user charges related to the operation of
174174 various public services, including public water supply services,
175175 for the collection and treatment of wastewater, and for the
176176 operation of storm-water facilities, including the regulation of
177177 storm water for the protection of water quality in the district, and
178178 for the provision of septic tank maintenance services inside and
179179 outside the district;
180180 (9) undertake separately or jointly with other persons
181181 all or part of the cost of an improvement project, including an
182182 improvement project:
183183 (A) for improving, enhancing, and supporting
184184 public safety and security, fire protection and emergency medical
185185 services, and law enforcement in and adjacent to the district; or
186186 (B) that confers a general benefit on the entire
187187 district or a special benefit on a definable part of the district;
188188 and
189189 (10) enter into a tax abatement agreement in
190190 accordance with the general laws of this state authorizing and
191191 applicable to tax abatement agreements by municipalities.
192192 SECTION 7. (a) All governmental and proprietary actions of
193193 the Lake View Management and Development District taken before the
194194 effective date of this Act are validated, ratified, and confirmed
195195 in all respects as if the actions had been taken as authorized by
196196 law.
197197 (b) This section does not apply to any matter that on the
198198 effective date of this Act:
199199 (1) is involved in litigation if the litigation
200200 ultimately results in the matter being held invalid by a final court
201201 judgment; or
202202 (2) has been held invalid by a final court judgment.
203203 SECTION 8. The legislature finds that:
204204 (1) proper and legal notice of the intention to
205205 introduce this Act, setting forth the general substance of this
206206 Act, has been published as provided by law, and the notice and a
207207 copy of this Act have been furnished to all persons, agencies,
208208 officials, or entities to which they are required to be furnished by
209209 the constitution and laws of this state, including the governor,
210210 who has submitted the notice and Act to the Texas Commission on
211211 Environmental Quality;
212212 (2) the Texas Commission on Environmental Quality has
213213 filed its recommendations relating to this Act with the governor,
214214 lieutenant governor, and speaker of the house of representatives
215215 within the required time; and
216216 (3) all requirements of the constitution and laws of
217217 this state and the rules and procedures of the legislature with
218218 respect to the notice, introduction, and passage of this Act have
219219 been fulfilled and accomplished.
220220 SECTION 9. This Act takes effect immediately if it receives
221221 a vote of two-thirds of all the members elected to each house, as
222222 provided by Section 39, Article III, Texas Constitution. If this
223223 Act does not receive the vote necessary for immediate effect, this
224224 Act takes effect September 1, 2009.
