12 | 12 | | CHAPTER 8355. MONTGOMERY COUNTY MUNICIPAL UTILITY DISTRICT NO. 128 |
---|
13 | 13 | | SUBCHAPTER A. GENERAL PROVISIONS |
---|
14 | 14 | | Sec. 8355.001. DEFINITIONS. In this chapter: |
---|
15 | 15 | | (1) "Board" means the district's board of directors. |
---|
16 | 16 | | (2) "Director" means a board member. |
---|
17 | 17 | | (3) "District" means the Montgomery County Municipal |
---|
18 | 18 | | Utility District No. 128. |
---|
19 | 19 | | Sec. 8355.002. NATURE OF DISTRICT. The district is a |
---|
20 | 20 | | municipal utility district created under Section 59, Article XVI, |
---|
21 | 21 | | Texas Constitution. |
---|
22 | 22 | | Sec. 8355.003. CONFIRMATION AND DIRECTORS' ELECTION |
---|
23 | 23 | | REQUIRED. The temporary directors shall hold an election to |
---|
24 | 24 | | confirm the creation of the district and to elect five permanent |
---|
25 | 25 | | directors as provided by Section 49.102, Water Code. |
---|
26 | 26 | | Sec. 8355.004. CONSENT OF MUNICIPALITY REQUIRED. The |
---|
27 | 27 | | temporary directors may not hold an election under Section 8355.003 |
---|
28 | 28 | | until each municipality in whose corporate limits or |
---|
29 | 29 | | extraterritorial jurisdiction the district is located has |
---|
30 | 30 | | consented by ordinance or resolution to the creation of the |
---|
31 | 31 | | district and to the inclusion of land in the district. |
---|
32 | 32 | | Sec. 8355.005. FINDINGS OF PUBLIC PURPOSE AND BENEFIT. |
---|
33 | 33 | | (a) The district is created to serve a public purpose and benefit. |
---|
34 | 34 | | (b) The district is created to accomplish the purposes of: |
---|
35 | 35 | | (1) a municipal utility district as provided by |
---|
36 | 36 | | general law and Section 59, Article XVI, Texas Constitution; and |
---|
37 | 37 | | (2) Section 52, Article III, Texas Constitution, that |
---|
38 | 38 | | relate to the construction, acquisition, improvement, operation, |
---|
39 | 39 | | or maintenance of macadamized, graveled, or paved roads, or |
---|
40 | 40 | | improvements, including storm drainage, in aid of those roads. |
---|
41 | 41 | | Sec. 8355.006. INITIAL DISTRICT TERRITORY. (a) The |
---|
42 | 42 | | district is initially composed of the territory described by |
---|
43 | 43 | | Section 2(a) of the Act creating this chapter. |
---|
44 | 44 | | (b) The boundaries and field notes contained in Section 2(a) |
---|
45 | 45 | | of the Act creating this chapter form a closure. A mistake made in |
---|
46 | 46 | | the field notes or in copying the field notes in the legislative |
---|
47 | 47 | | process does not affect the district's: |
---|
48 | 48 | | (1) organization, existence, or validity; |
---|
49 | 49 | | (2) right to issue any type of bond for the purposes |
---|
50 | 50 | | for which the district is created or to pay the principal of and |
---|
51 | 51 | | interest on a bond; |
---|
52 | 52 | | (3) right to impose a tax; or |
---|
53 | 53 | | (4) legality or operation. |
---|

55 | 55 | | SUBCHAPTER B. BOARD OF DIRECTORS |
---|
56 | 56 | | Sec. 8355.051. GOVERNING BODY; TERMS. (a) The district is |
---|
57 | 57 | | governed by a board of five elected directors. |
---|
58 | 58 | | (b) Except as provided by Section 8355.052, directors serve |
---|
59 | 59 | | staggered four-year terms. |
---|
60 | 60 | | Sec. 8355.052. TEMPORARY DIRECTORS. (a) The temporary |
---|
61 | 61 | | board consists of: |
---|
62 | 62 | | (1) H. Daniel Wright; |
---|
63 | 63 | | (2) Justin Hood; |
---|
64 | 64 | | (3) Sherry Barker; |
---|
65 | 65 | | (4) Noe Carrasco; and |
---|
66 | 66 | | (5) Rusty Wilson. |
---|
67 | 67 | | (b) If a temporary director fails to qualify for office, the |
---|
68 | 68 | | temporary directors who have qualified shall appoint a person to |
---|
69 | 69 | | fill the vacancy. |
---|
70 | 70 | | (c) Temporary directors serve until the earlier of: |
---|
71 | 71 | | (1) the date permanent directors are elected under |
---|
72 | 72 | | Section 8355.003; or |
---|
73 | 73 | | (2) September 1, 2013. |
---|
74 | 74 | | (d) If permanent directors have not been elected under |
---|
75 | 75 | | Section 8355.003 and the terms of the temporary directors have |
---|
76 | 76 | | expired, successor temporary directors shall be appointed or |
---|
77 | 77 | | reappointed as provided by Subsection (e) to serve terms that |
---|
78 | 78 | | expire on the earlier of: |
---|
79 | 79 | | (1) the date permanent directors are elected under |
---|
80 | 80 | | Section 8355.003; or |
---|
81 | 81 | | (2) the fourth anniversary of the date of the |
---|
82 | 82 | | appointment or reappointment. |
---|
83 | 83 | | (e) If Subsection (d) applies, the owner or owners of a |
---|
84 | 84 | | majority of the assessed value of the real property in the district |
---|
85 | 85 | | may submit a petition to the Texas Commission on Environmental |
---|
86 | 86 | | Quality requesting that the commission appoint as successor |
---|
87 | 87 | | temporary directors the five persons named in the petition. The |
---|
88 | 88 | | commission shall appoint as successor temporary directors the five |
---|
89 | 89 | | persons named in the petition. |
---|

91 | 91 | | SUBCHAPTER C. POWERS AND DUTIES |
---|
92 | 92 | | Sec. 8355.101. GENERAL POWERS AND DUTIES. The district has |
---|
93 | 93 | | the powers and duties necessary to accomplish the purposes for |
---|
94 | 94 | | which the district is created. |
---|
95 | 95 | | Sec. 8355.102. MUNICIPAL UTILITY DISTRICT POWERS AND |
---|
96 | 96 | | DUTIES. The district has the powers and duties provided by the |
---|
97 | 97 | | general law of this state, including Chapters 49 and 54, Water Code, |
---|
98 | 98 | | applicable to municipal utility districts created under Section 59, |
---|
99 | 99 | | Article XVI, Texas Constitution. |
---|
100 | 100 | | Sec. 8355.103. AUTHORITY FOR ROAD PROJECTS. Under Section |
---|
101 | 101 | | 52, Article III, Texas Constitution, the district may design, |
---|
102 | 102 | | acquire, construct, finance, issue bonds for, improve, operate, |
---|
103 | 103 | | maintain, and convey to this state, a county, or a municipality for |
---|
104 | 104 | | operation and maintenance macadamized, graveled, or paved roads, or |
---|
105 | 105 | | improvements, including storm drainage, in aid of those roads. |
---|
106 | 106 | | Sec. 8355.104. ROAD STANDARDS AND REQUIREMENTS. (a) A |
---|
107 | 107 | | road project must meet all applicable construction standards, |
---|
108 | 108 | | subdivision requirements, and regulations of each municipality in |
---|
109 | 109 | | whose corporate limits or extraterritorial jurisdiction the road |
---|
110 | 110 | | project is located. |
---|
111 | 111 | | (b) If a road project is not located in the corporate limits |
---|
112 | 112 | | or extraterritorial jurisdiction of a municipality, the road |
---|
113 | 113 | | project must meet all applicable construction standards, |
---|
114 | 114 | | subdivision requirements, and regulations of each county in which |
---|
115 | 115 | | the road project is located. |
---|
116 | 116 | | (c) If the state will maintain and operate the road, the |
---|
117 | 117 | | Texas Transportation Commission must approve the plans and |
---|
118 | 118 | | specifications of the road project. |
---|
119 | 119 | | Sec. 8355.105. DIVISION OF DISTRICT. (a) The district may |
---|
120 | 120 | | be divided into two or more new districts only if the district: |
---|
121 | 121 | | (1) has no outstanding bonded debt; and |
---|
122 | 122 | | (2) is not imposing ad valorem taxes. |
---|
123 | 123 | | (b) This chapter applies to any new district created by the |
---|
124 | 124 | | division of the district, and a new district has all the powers and |
---|
125 | 125 | | duties of the district. |
---|
126 | 126 | | (c) Any new district created by the division of the district |
---|
127 | 127 | | may not, at the time the new district is created: |
---|
128 | 128 | | (1) contain any land outside the area described by |
---|
129 | 129 | | Section 2(a) of the Act creating this chapter; or |
---|
130 | 130 | | (2) contain less than 200 or more than 600 acres of |
---|
131 | 131 | | land without the prior consent of any municipality in whose |
---|
132 | 132 | | extraterritorial jurisdiction the district is located. |
---|
133 | 133 | | (d) The board, on its own motion or on receipt of a petition |
---|
134 | 134 | | signed by the owner or owners of a majority of the assessed value of |
---|
135 | 135 | | the real property in the district, may adopt an order dividing the |
---|
136 | 136 | | district. |
---|
137 | 137 | | (e) The board may adopt an order dividing the district |
---|
138 | 138 | | before or after the date the board holds an election under Section |
---|
139 | 139 | | 8355.003 to confirm the district's creation. |
---|
140 | 140 | | (f) An order dividing the district shall: |
---|
141 | 141 | | (1) name each new district; |
---|
142 | 142 | | (2) include the metes and bounds description of the |
---|
143 | 143 | | territory of each new district; |
---|
144 | 144 | | (3) appoint temporary directors for each new district; |
---|
145 | 145 | | and |
---|
146 | 146 | | (4) provide for the division of assets and liabilities |
---|
147 | 147 | | between or among the new districts. |
---|
148 | 148 | | (g) On or before the 30th day after the date of adoption of |
---|
149 | 149 | | an order dividing the district, the district shall file the order |
---|
150 | 150 | | with the Texas Commission on Environmental Quality and record the |
---|
151 | 151 | | order in the real property records of each county in which the |
---|
152 | 152 | | district is located. |
---|
153 | 153 | | (h) Any new district created by the division of the district |
---|
154 | 154 | | shall hold a confirmation and directors' election as required by |
---|
155 | 155 | | Section 8355.003. A new district that is not confirmed is subject |
---|
156 | 156 | | to dissolution under general law. |
---|
157 | 157 | | (i) Except as provided by Subsection (c), municipal consent |
---|
158 | 158 | | to the creation of the district and to the inclusion of land in the |
---|
159 | 159 | | district granted under Section 8355.004 acts as municipal consent |
---|
160 | 160 | | to the creation of any new district created by the division of the |
---|
161 | 161 | | district and to the inclusion of land in the new district. |
---|
162 | 162 | | (j) Any new district created by the division of the district |
---|
163 | 163 | | must hold an election as required by this chapter to obtain voter |
---|
164 | 164 | | approval before the district may impose a maintenance tax or issue |
---|
165 | 165 | | bonds payable wholly or partly from ad valorem taxes. |
---|
166 | 166 | | Sec. 8355.106. COMPLIANCE WITH MUNICIPAL CONSENT ORDINANCE |
---|
167 | 167 | | OR RESOLUTION. The district shall comply with all applicable |
---|
168 | 168 | | requirements of any ordinance or resolution that is adopted under |
---|
169 | 169 | | Section 54.016 or 54.0165, Water Code, and that consents to the |
---|
170 | 170 | | creation of the district or to the inclusion of land in the |
---|
171 | 171 | | district. |
---|
172 | 172 | | Sec. 8355.107. EFFECT OF ANNEXATION. (a) A municipality |
---|
173 | 173 | | within whose extraterritorial jurisdiction the land in the district |
---|
174 | 174 | | lies may annex all of the district into its corporate limits under |
---|
175 | 175 | | the terms of an agreement entered into before the effective date of |
---|
176 | 176 | | the Act creating this chapter between the municipality and the |
---|
177 | 177 | | owners of the land being annexed, and, in that instance, the |
---|
178 | 178 | | district may not be dissolved, except as provided by Subsection |
---|
179 | 179 | | (b). |
---|
180 | 180 | | (b) The district may be dissolved and its debts and |
---|
181 | 181 | | obligations assumed by the municipality in accordance with Chapter |
---|
182 | 182 | | 43, Local Government Code, including Sections 43.075 and 43.0715, |
---|
183 | 183 | | on: |
---|
184 | 184 | | (1) annexation of all of the territory of the district |
---|
185 | 185 | | by the municipality; and |
---|
186 | 186 | | (2) completion of the construction of the water, |
---|
187 | 187 | | sanitary sewer, and drainage improvements and roads required to |
---|
188 | 188 | | serve at least 95 percent of the land in the district. |
---|
189 | 189 | | (c) Notwithstanding Section 54.016(f)(2), Water Code, a |
---|
190 | 190 | | contract between the municipality and the district that provides |
---|
191 | 191 | | for the allocation of the taxes or revenues between the district and |
---|
192 | 192 | | the municipality following the date of inclusion of all the |
---|
193 | 193 | | district's territory in the corporate limits of the municipality |
---|
194 | 194 | | may provide that the total annual ad valorem taxes collected by the |
---|
195 | 195 | | municipality and the district from taxable property in the district |
---|
196 | 196 | | may exceed the municipality's ad valorem tax on the property. |
---|
197 | 197 | | Sec. 8355.108. LIMITATION ON USE OF EMINENT DOMAIN. The |
---|
198 | 198 | | district may not exercise the power of eminent domain outside the |
---|
199 | 199 | | district to acquire a site or easement for: |
---|
200 | 200 | | (1) a road project authorized by Section 8355.103; or |
---|
201 | 201 | | (2) a recreational facility as defined by Section |
---|
202 | 202 | | 49.462, Water Code. |
---|

204 | 204 | | SUBCHAPTER D. GENERAL FINANCIAL PROVISIONS |
---|
205 | 205 | | Sec. 8355.151. ELECTIONS REGARDING TAXES OR BONDS. |
---|
206 | 206 | | (a) The district may issue, without an election, bonds and other |
---|
207 | 207 | | obligations secured by: |
---|
208 | 208 | | (1) revenue other than ad valorem taxes; or |
---|
209 | 209 | | (2) contract payments described by Section 8355.153. |
---|
210 | 210 | | (b) The district must hold an election in the manner |
---|
211 | 211 | | provided by Chapters 49 and 54, Water Code, to obtain voter approval |
---|
212 | 212 | | before the district may impose an ad valorem tax or issue bonds |
---|
213 | 213 | | payable from ad valorem taxes. |
---|
214 | 214 | | (c) The district may not issue bonds payable from ad valorem |
---|
215 | 215 | | taxes to finance a road project unless the issuance is approved by a |
---|
216 | 216 | | vote of a two-thirds majority of the district voters voting at an |
---|
217 | 217 | | election held for that purpose. |
---|
218 | 218 | | Sec. 8355.152. OPERATION AND MAINTENANCE TAX. (a) If |
---|
219 | 219 | | authorized at an election held under Section 8355.151, the district |
---|
220 | 220 | | may impose an operation and maintenance tax on taxable property in |
---|
221 | 221 | | the district in accordance with Section 49.107, Water Code. |
---|
222 | 222 | | (b) The board shall determine the tax rate. The rate may not |
---|
223 | 223 | | exceed the rate approved at the election. |
---|
224 | 224 | | Sec. 8355.153. CONTRACT TAXES. (a) In accordance with |
---|
225 | 225 | | Section 49.108, Water Code, the district may impose a tax other than |
---|
226 | 226 | | an operation and maintenance tax and use the revenue derived from |
---|
227 | 227 | | the tax to make payments under a contract after the provisions of |
---|
228 | 228 | | the contract have been approved by a majority of the district voters |
---|
229 | 229 | | voting at an election held for that purpose. |
---|
230 | 230 | | (b) A contract approved by the district voters may contain a |
---|
231 | 231 | | provision stating that the contract may be modified or amended by |
---|
232 | 232 | | the board without further voter approval. |
---|

234 | 234 | | SUBCHAPTER E. BONDS AND OTHER OBLIGATIONS |
---|
235 | 235 | | Sec. 8355.201. AUTHORITY TO ISSUE BONDS AND OTHER |
---|
236 | 236 | | OBLIGATIONS. The district may issue bonds or other obligations |
---|
237 | 237 | | payable wholly or partly from ad valorem taxes, impact fees, |
---|
238 | 238 | | revenue, including revenue received by the district under Chapter |
---|
239 | 239 | | 311, Tax Code, and Chapter 380, Local Government Code, assessments, |
---|
240 | 240 | | grants, or other district money, or any combination of those |
---|
241 | 241 | | sources, to pay for any authorized district purpose. |
---|
242 | 242 | | Sec. 8355.202. TAXES FOR BONDS. At the time the district |
---|
243 | 243 | | issues bonds payable wholly or partly from ad valorem taxes, the |
---|
244 | 244 | | board shall provide for the annual imposition of a continuing |
---|
245 | 245 | | direct ad valorem tax, without limit as to rate or amount, while all |
---|
246 | 246 | | or part of the bonds are outstanding as required and in the manner |
---|
247 | 247 | | provided by Sections 54.601 and 54.602, Water Code. |
---|
248 | 248 | | Sec. 8355.203. BONDS FOR ROAD PROJECTS. At the time of |
---|
249 | 249 | | issuance, the total principal amount of bonds or other obligations |
---|
250 | 250 | | issued or incurred to finance road projects and payable from ad |
---|
251 | 251 | | valorem taxes may not exceed one-fourth of the assessed value of the |
---|
252 | 252 | | real property in the district. |

---|
341 | 341 | | Sec. 8356.103. AUTHORITY FOR ROAD PROJECTS. Under Section |
---|
342 | 342 | | 52, Article III, Texas Constitution, the district may design, |
---|
343 | 343 | | acquire, construct, finance, issue bonds for, improve, operate, |
---|
344 | 344 | | maintain, and convey to this state, a county, or a municipality for |
---|
345 | 345 | | operation and maintenance macadamized, graveled, or paved roads, or |
---|
346 | 346 | | improvements, including storm drainage, in aid of those roads. |
---|
347 | 347 | | Sec. 8356.104. ROAD STANDARDS AND REQUIREMENTS. (a) A |
---|
348 | 348 | | road project must meet all applicable construction standards, |
---|
349 | 349 | | subdivision requirements, and regulations of each municipality in |
---|
350 | 350 | | whose corporate limits or extraterritorial jurisdiction the road |
---|
351 | 351 | | project is located. |
---|
352 | 352 | | (b) If a road project is not located in the corporate limits |
---|
353 | 353 | | or extraterritorial jurisdiction of a municipality, the road |
---|
354 | 354 | | project must meet all applicable construction standards, |
---|
355 | 355 | | subdivision requirements, and regulations of each county in which |
---|
356 | 356 | | the road project is located. |
---|
357 | 357 | | (c) If the state will maintain and operate the road, the |
---|
358 | 358 | | Texas Transportation Commission must approve the plans and |
---|
359 | 359 | | specifications of the road project. |
---|
360 | 360 | | Sec. 8356.105. DIVISION OF DISTRICT. (a) The district may |
---|
361 | 361 | | be divided into two or more new districts only if the district: |
---|
362 | 362 | | (1) has no outstanding bonded debt; and |
---|
363 | 363 | | (2) is not imposing ad valorem taxes. |
---|
364 | 364 | | (b) This chapter applies to any new district created by the |
---|
365 | 365 | | division of the district, and a new district has all the powers and |
---|
366 | 366 | | duties of the district. |
---|
367 | 367 | | (c) Any new district created by the division of the district |
---|
368 | 368 | | may not, at the time the new district is created: |
---|
369 | 369 | | (1) contain any land outside the area described by |
---|
370 | 370 | | Section 2(b) of the Act creating this chapter; or |
---|
371 | 371 | | (2) contain less than 200 or more than 600 acres of |
---|
372 | 372 | | land without the prior consent of any municipality in whose |
---|
373 | 373 | | extraterritorial jurisdiction the district is located. |
---|
374 | 374 | | (d) The board, on its own motion or on receipt of a petition |
---|
375 | 375 | | signed by the owner or owners of a majority of the assessed value of |
---|
376 | 376 | | the real property in the district, may adopt an order dividing the |
---|
377 | 377 | | district. |
---|
378 | 378 | | (e) The board may adopt an order dividing the district |
---|
379 | 379 | | before or after the date the board holds an election under Section |
---|
380 | 380 | | 8356.003 to confirm the district's creation. |
---|
381 | 381 | | (f) An order dividing the district shall: |
---|
382 | 382 | | (1) name each new district; |
---|
383 | 383 | | (2) include the metes and bounds description of the |
---|
384 | 384 | | territory of each new district; |
---|
385 | 385 | | (3) appoint temporary directors for each new district; |
---|
386 | 386 | | and |
---|
387 | 387 | | (4) provide for the division of assets and liabilities |
---|
388 | 388 | | between or among the new districts. |
---|
389 | 389 | | (g) On or before the 30th day after the date of adoption of |
---|
390 | 390 | | an order dividing the district, the district shall file the order |
---|
391 | 391 | | with the Texas Commission on Environmental Quality and record the |
---|
392 | 392 | | order in the real property records of each county in which the |
---|
393 | 393 | | district is located. |
---|
394 | 394 | | (h) Any new district created by the division of the district |
---|
395 | 395 | | shall hold a confirmation and directors' election as required by |
---|
396 | 396 | | Section 8356.003. A new district that is not confirmed is subject |
---|
397 | 397 | | to dissolution under general law. |
---|
398 | 398 | | (i) Except as provided by Subsection (c), municipal consent |
---|
399 | 399 | | to the creation of the district and to the inclusion of land in the |
---|
400 | 400 | | district granted under Section 8356.004 acts as municipal consent |
---|
401 | 401 | | to the creation of any new district created by the division of the |
---|
402 | 402 | | district and to the inclusion of land in the new district. |
---|
403 | 403 | | (j) Any new district created by the division of the district |
---|
404 | 404 | | must hold an election as required by this chapter to obtain voter |
---|
405 | 405 | | approval before the district may impose a maintenance tax or issue |
---|
406 | 406 | | bonds payable wholly or partly from ad valorem taxes. |
---|
407 | 407 | | Sec. 8356.106. COMPLIANCE WITH MUNICIPAL CONSENT ORDINANCE |
---|
408 | 408 | | OR RESOLUTION. The district shall comply with all applicable |
---|
409 | 409 | | requirements of any ordinance or resolution that is adopted under |
---|
410 | 410 | | Section 54.016 or 54.0165, Water Code, and that consents to the |
---|
411 | 411 | | creation of the district or to the inclusion of land in the |
---|
412 | 412 | | district. |
---|
413 | 413 | | Sec. 8356.107. EFFECT OF ANNEXATION. (a) A municipality |
---|
414 | 414 | | within whose extraterritorial jurisdiction the land in the district |
---|
415 | 415 | | lies may annex all of the district into its corporate limits under |
---|
416 | 416 | | the terms of an agreement entered into before the effective date of |
---|
417 | 417 | | the Act creating this chapter between the municipality and the |
---|
418 | 418 | | owners of the land being annexed, and, in that instance, the |
---|
419 | 419 | | district may not be dissolved, except as provided by Subsection |
---|
420 | 420 | | (b). |
---|
421 | 421 | | (b) The district may be dissolved and its debts and |
---|
422 | 422 | | obligations assumed by the municipality in accordance with Chapter |
---|
423 | 423 | | 43, Local Government Code, including Sections 43.075 and 43.0715, |
---|
424 | 424 | | on: |
---|
425 | 425 | | (1) annexation of all of the territory of the district |
---|
426 | 426 | | by the municipality; and |
---|
427 | 427 | | (2) completion of the construction of the water, |
---|
428 | 428 | | sanitary sewer, and drainage improvements and roads required to |
---|
429 | 429 | | serve at least 95 percent of the land in the district. |
---|
430 | 430 | | (c) Notwithstanding Section 54.016(f)(2), Water Code, a |
---|
431 | 431 | | contract between the municipality and the district that provides |
---|
432 | 432 | | for the allocation of the taxes or revenues between the district and |
---|
433 | 433 | | the municipality following the date of inclusion of all the |
---|
434 | 434 | | district's territory in the corporate limits of the municipality |
---|
435 | 435 | | may provide that the total annual ad valorem taxes collected by the |
---|
436 | 436 | | municipality and the district from taxable property in the district |
---|
437 | 437 | | may exceed the municipality's ad valorem tax on the property. |
---|
438 | 438 | | Sec. 8356.108. LIMITATION ON USE OF EMINENT DOMAIN. The |
---|
439 | 439 | | district may not exercise the power of eminent domain outside the |
---|
440 | 440 | | district to acquire a site or easement for: |
---|
441 | 441 | | (1) a road project authorized by Section 8356.103; or |
---|
442 | 442 | | (2) a recreational facility as defined by Section |
---|
443 | 443 | | 49.462, Water Code. |
---|

445 | 445 | | SUBCHAPTER D. GENERAL FINANCIAL PROVISIONS |
---|
446 | 446 | | Sec. 8356.151. ELECTIONS REGARDING TAXES OR BONDS. |

447 | 447 | | (a) The district may issue, without an election, bonds and other |
---|
448 | 448 | | obligations secured by: |
---|
449 | 449 | | (1) revenue other than ad valorem taxes; or |
---|
450 | 450 | | (2) contract payments described by Section 8356.153. |
---|
451 | 451 | | (b) The district must hold an election in the manner |
---|
452 | 452 | | provided by Chapters 49 and 54, Water Code, to obtain voter approval |
---|
453 | 453 | | before the district may impose an ad valorem tax or issue bonds |
---|
454 | 454 | | payable from ad valorem taxes. |
---|
455 | 455 | | (c) The district may not issue bonds payable from ad valorem |
---|
456 | 456 | | taxes to finance a road project unless the issuance is approved by a |
---|
457 | 457 | | vote of a two-thirds majority of the district voters voting at an |
---|
458 | 458 | | election held for that purpose. |
---|
459 | 459 | | Sec. 8356.152. OPERATION AND MAINTENANCE TAX. (a) If |
---|
460 | 460 | | authorized at an election held under Section 8356.151, the district |
---|
461 | 461 | | may impose an operation and maintenance tax on taxable property in |
---|
462 | 462 | | the district in accordance with Section 49.107, Water Code. |
---|
463 | 463 | | (b) The board shall determine the tax rate. The rate may not |
---|
464 | 464 | | exceed the rate approved at the election. |
---|
465 | 465 | | Sec. 8356.153. CONTRACT TAXES. (a) In accordance with |
---|
466 | 466 | | Section 49.108, Water Code, the district may impose a tax other than |
---|
467 | 467 | | an operation and maintenance tax and use the revenue derived from |
---|
468 | 468 | | the tax to make payments under a contract after the provisions of |
---|
469 | 469 | | the contract have been approved by a majority of the district voters |
---|
470 | 470 | | voting at an election held for that purpose. |
---|
471 | 471 | | (b) A contract approved by the district voters may contain a |
---|
472 | 472 | | provision stating that the contract may be modified or amended by |
---|
473 | 473 | | the board without further voter approval. |
---|

481 | 481 | | grants, or other district money, or any combination of those |
---|
482 | 482 | | sources, to pay for any authorized district purpose. |
---|
483 | 483 | | Sec. 8356.202. TAXES FOR BONDS. At the time the district |
---|
484 | 484 | | issues bonds payable wholly or partly from ad valorem taxes, the |
---|
485 | 485 | | board shall provide for the annual imposition of a continuing |
---|
486 | 486 | | direct ad valorem tax, without limit as to rate or amount, while all |
---|
487 | 487 | | or part of the bonds are outstanding as required and in the manner |
---|
488 | 488 | | provided by Sections 54.601 and 54.602, Water Code. |
---|
489 | 489 | | Sec. 8356.203. BONDS FOR ROAD PROJECTS. At the time of |
---|
490 | 490 | | issuance, the total principal amount of bonds or other obligations |
---|
491 | 491 | | issued or incurred to finance road projects and payable from ad |
---|
492 | 492 | | valorem taxes may not exceed one-fourth of the assessed value of the |
---|
