55 relating to the creation of the Montgomery County Municipal Utility
66 Districts Nos. 128 and 129; providing authority to impose a tax and
77 issue bonds; granting a limited power of eminent domain.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Subtitle F, Title 6, Special District Local Laws
1010 Code, is amended by adding Chapters 8355 and 8356 to read as
1111 follows:
1212 CHAPTER 8355. MONTGOMERY COUNTY MUNICIPAL UTILITY DISTRICT NO. 128
1313 SUBCHAPTER A. GENERAL PROVISIONS
1414 Sec. 8355.001. DEFINITIONS. In this chapter:
1515 (1) "Board" means the district's board of directors.
1616 (2) "Director" means a board member.
1717 (3) "District" means the Montgomery County Municipal
1818 Utility District No. 128.
1919 Sec. 8355.002. NATURE OF DISTRICT. The district is a
2020 municipal utility district created under Section 59, Article XVI,
2121 Texas Constitution.
2222 Sec. 8355.003. CONFIRMATION AND DIRECTORS' ELECTION
2323 REQUIRED. The temporary directors shall hold an election to
2424 confirm the creation of the district and to elect five permanent
2525 directors as provided by Section 49.102, Water Code.
2626 Sec. 8355.004. CONSENT OF MUNICIPALITY REQUIRED. The
2727 temporary directors may not hold an election under Section 8355.003
2828 until each municipality in whose corporate limits or
2929 extraterritorial jurisdiction the district is located has
3030 consented by ordinance or resolution to the creation of the
3131 district and to the inclusion of land in the district.
3232 Sec. 8355.005. FINDINGS OF PUBLIC PURPOSE AND BENEFIT.
3333 (a) The district is created to serve a public purpose and benefit.
3434 (b) The district is created to accomplish the purposes of:
3535 (1) a municipal utility district as provided by
3636 general law and Section 59, Article XVI, Texas Constitution; and
3737 (2) Section 52, Article III, Texas Constitution, that
3838 relate to the construction, acquisition, improvement, operation,
3939 or maintenance of macadamized, graveled, or paved roads, or
4040 improvements, including storm drainage, in aid of those roads.
4141 Sec. 8355.006. INITIAL DISTRICT TERRITORY. (a) The
4242 district is initially composed of the territory described by
4343 Section 2(a) of the Act creating this chapter.
4444 (b) The boundaries and field notes contained in Section 2(a)
4545 of the Act creating this chapter form a closure. A mistake made in
4646 the field notes or in copying the field notes in the legislative
4747 process does not affect the district's:
4848 (1) organization, existence, or validity;
4949 (2) right to issue any type of bond for the purposes
5050 for which the district is created or to pay the principal of and
5151 interest on a bond;
5252 (3) right to impose a tax; or
5353 (4) legality or operation.

5555 SUBCHAPTER B. BOARD OF DIRECTORS
5656 Sec. 8355.051. GOVERNING BODY; TERMS. (a) The district is
5757 governed by a board of five elected directors.
5858 (b) Except as provided by Section 8355.052, directors serve
5959 staggered four-year terms.
6060 Sec. 8355.052. TEMPORARY DIRECTORS. (a) The temporary
6161 board consists of:
6262 (1) H. Daniel Wright;
6363 (2) Justin Hood;
6464 (3) Sherry Barker;
6565 (4) Noe Carrasco; and
6666 (5) Rusty Wilson.
6767 (b) If a temporary director fails to qualify for office, the
6868 temporary directors who have qualified shall appoint a person to
6969 fill the vacancy.
7070 (c) Temporary directors serve until the earlier of:
7171 (1) the date permanent directors are elected under
7272 Section 8355.003; or
7373 (2) September 1, 2013.
7474 (d) If permanent directors have not been elected under
7575 Section 8355.003 and the terms of the temporary directors have
7676 expired, successor temporary directors shall be appointed or
7777 reappointed as provided by Subsection (e) to serve terms that
7878 expire on the earlier of:
7979 (1) the date permanent directors are elected under
8080 Section 8355.003; or
8181 (2) the fourth anniversary of the date of the
8282 appointment or reappointment.
8383 (e) If Subsection (d) applies, the owner or owners of a
8484 majority of the assessed value of the real property in the district
8585 may submit a petition to the Texas Commission on Environmental
8686 Quality requesting that the commission appoint as successor
8787 temporary directors the five persons named in the petition. The
8888 commission shall appoint as successor temporary directors the five
8989 persons named in the petition.

9191 SUBCHAPTER C. POWERS AND DUTIES
9292 Sec. 8355.101. GENERAL POWERS AND DUTIES. The district has
9393 the powers and duties necessary to accomplish the purposes for
9494 which the district is created.
9595 Sec. 8355.102. MUNICIPAL UTILITY DISTRICT POWERS AND
9696 DUTIES. The district has the powers and duties provided by the
9797 general law of this state, including Chapters 49 and 54, Water Code,
9898 applicable to municipal utility districts created under Section 59,
9999 Article XVI, Texas Constitution.
100100 Sec. 8355.103. AUTHORITY FOR ROAD PROJECTS. Under Section
101101 52, Article III, Texas Constitution, the district may design,
102102 acquire, construct, finance, issue bonds for, improve, operate,
103103 maintain, and convey to this state, a county, or a municipality for
104104 operation and maintenance macadamized, graveled, or paved roads, or
105105 improvements, including storm drainage, in aid of those roads.
106106 Sec. 8355.104. ROAD STANDARDS AND REQUIREMENTS. (a) A
107107 road project must meet all applicable construction standards,
108108 subdivision requirements, and regulations of each municipality in
109109 whose corporate limits or extraterritorial jurisdiction the road
110110 project is located.
111111 (b) If a road project is not located in the corporate limits
112112 or extraterritorial jurisdiction of a municipality, the road
113113 project must meet all applicable construction standards,
114114 subdivision requirements, and regulations of each county in which
115115 the road project is located.
116116 (c) If the state will maintain and operate the road, the
117117 Texas Transportation Commission must approve the plans and
118118 specifications of the road project.
119119 Sec. 8355.105. DIVISION OF DISTRICT. (a) The district may
120120 be divided into two or more new districts only if the district:
121121 (1) has no outstanding bonded debt; and
122122 (2) is not imposing ad valorem taxes.
123123 (b) This chapter applies to any new district created by the
124124 division of the district, and a new district has all the powers and
125125 duties of the district.
126126 (c) Any new district created by the division of the district
127127 may not, at the time the new district is created:
128128 (1) contain any land outside the area described by
129129 Section 2(a) of the Act creating this chapter; or
130130 (2) contain less than 200 or more than 600 acres of
131131 land without the prior consent of any municipality in whose
132132 extraterritorial jurisdiction the district is located.
133133 (d) The board, on its own motion or on receipt of a petition
134134 signed by the owner or owners of a majority of the assessed value of
135135 the real property in the district, may adopt an order dividing the
136136 district.
137137 (e) The board may adopt an order dividing the district
138138 before or after the date the board holds an election under Section
139139 8355.003 to confirm the district's creation.
140140 (f) An order dividing the district shall:
141141 (1) name each new district;
142142 (2) include the metes and bounds description of the
143143 territory of each new district;
144144 (3) appoint temporary directors for each new district;
145145 and
146146 (4) provide for the division of assets and liabilities
147147 between or among the new districts.
148148 (g) On or before the 30th day after the date of adoption of
149149 an order dividing the district, the district shall file the order
150150 with the Texas Commission on Environmental Quality and record the
151151 order in the real property records of each county in which the
152152 district is located.
153153 (h) Any new district created by the division of the district
154154 shall hold a confirmation and directors' election as required by
155155 Section 8355.003. A new district that is not confirmed is subject
156156 to dissolution under general law.
157157 (i) Except as provided by Subsection (c), municipal consent
158158 to the creation of the district and to the inclusion of land in the
159159 district granted under Section 8355.004 acts as municipal consent
160160 to the creation of any new district created by the division of the
161161 district and to the inclusion of land in the new district.
162162 (j) Any new district created by the division of the district
163163 must hold an election as required by this chapter to obtain voter
164164 approval before the district may impose a maintenance tax or issue
165165 bonds payable wholly or partly from ad valorem taxes.
166166 Sec. 8355.106. COMPLIANCE WITH MUNICIPAL CONSENT ORDINANCE
167167 OR RESOLUTION. The district shall comply with all applicable
168168 requirements of any ordinance or resolution that is adopted under
169169 Section 54.016 or 54.0165, Water Code, and that consents to the
170170 creation of the district or to the inclusion of land in the
171171 district.
172172 Sec. 8355.107. EFFECT OF ANNEXATION. (a) A municipality
173173 within whose extraterritorial jurisdiction the land in the district
174174 lies may annex all of the district into its corporate limits under
175175 the terms of an agreement entered into before the effective date of
176176 the Act creating this chapter between the municipality and the
177177 owners of the land being annexed, and, in that instance, the
178178 district may not be dissolved, except as provided by Subsection
179179 (b).
180180 (b) The district may be dissolved and its debts and
181181 obligations assumed by the municipality in accordance with Chapter
182182 43, Local Government Code, including Sections 43.075 and 43.0715,
183183 on:
184184 (1) annexation of all of the territory of the district
185185 by the municipality; and
186186 (2) completion of the construction of the water,
187187 sanitary sewer, and drainage improvements and roads required to
188188 serve at least 95 percent of the land in the district.
189189 (c) Notwithstanding Section 54.016(f)(2), Water Code, a
190190 contract between the municipality and the district that provides
191191 for the allocation of the taxes or revenues between the district and
192192 the municipality following the date of inclusion of all the
193193 district's territory in the corporate limits of the municipality
194194 may provide that the total annual ad valorem taxes collected by the
195195 municipality and the district from taxable property in the district
196196 may exceed the municipality's ad valorem tax on the property.
197197 Sec. 8355.108. LIMITATION ON USE OF EMINENT DOMAIN. The
198198 district may not exercise the power of eminent domain outside the
199199 district to acquire a site or easement for:
200200 (1) a road project authorized by Section 8355.103; or
201201 (2) a recreational facility as defined by Section
202202 49.462, Water Code.

205205 Sec. 8355.151. ELECTIONS REGARDING TAXES OR BONDS.
206206 (a) The district may issue, without an election, bonds and other
207207 obligations secured by:
208208 (1) revenue other than ad valorem taxes; or
209209 (2) contract payments described by Section 8355.153.
210210 (b) The district must hold an election in the manner
211211 provided by Chapters 49 and 54, Water Code, to obtain voter approval
212212 before the district may impose an ad valorem tax or issue bonds
213213 payable from ad valorem taxes.
214214 (c) The district may not issue bonds payable from ad valorem
215215 taxes to finance a road project unless the issuance is approved by a
216216 vote of a two-thirds majority of the district voters voting at an
217217 election held for that purpose.
218218 Sec. 8355.152. OPERATION AND MAINTENANCE TAX. (a) If
219219 authorized at an election held under Section 8355.151, the district
220220 may impose an operation and maintenance tax on taxable property in
221221 the district in accordance with Section 49.107, Water Code.
222222 (b) The board shall determine the tax rate. The rate may not
223223 exceed the rate approved at the election.
224224 Sec. 8355.153. CONTRACT TAXES. (a) In accordance with
225225 Section 49.108, Water Code, the district may impose a tax other than
226226 an operation and maintenance tax and use the revenue derived from
227227 the tax to make payments under a contract after the provisions of
228228 the contract have been approved by a majority of the district voters
229229 voting at an election held for that purpose.
230230 (b) A contract approved by the district voters may contain a
231231 provision stating that the contract may be modified or amended by
232232 the board without further voter approval.

234234 SUBCHAPTER E. BONDS AND OTHER OBLIGATIONS
235235 Sec. 8355.201. AUTHORITY TO ISSUE BONDS AND OTHER
236236 OBLIGATIONS. The district may issue bonds or other obligations
237237 payable wholly or partly from ad valorem taxes, impact fees,
238238 revenue, including revenue received by the district under Chapter
239239 311, Tax Code, and Chapter 380, Local Government Code, assessments,
240240 grants, or other district money, or any combination of those
241241 sources, to pay for any authorized district purpose.
242242 Sec. 8355.202. TAXES FOR BONDS. At the time the district
243243 issues bonds payable wholly or partly from ad valorem taxes, the
244244 board shall provide for the annual imposition of a continuing
245245 direct ad valorem tax, without limit as to rate or amount, while all
246246 or part of the bonds are outstanding as required and in the manner
247247 provided by Sections 54.601 and 54.602, Water Code.
248248 Sec. 8355.203. BONDS FOR ROAD PROJECTS. At the time of
249249 issuance, the total principal amount of bonds or other obligations
250250 issued or incurred to finance road projects and payable from ad
251251 valorem taxes may not exceed one-fourth of the assessed value of the
252252 real property in the district.

451451 (b) The district must hold an election in the manner
452452 provided by Chapters 49 and 54, Water Code, to obtain voter approval
453453 before the district may impose an ad valorem tax or issue bonds
454454 payable from ad valorem taxes.
455455 (c) The district may not issue bonds payable from ad valorem
456456 taxes to finance a road project unless the issuance is approved by a
457457 vote of a two-thirds majority of the district voters voting at an
458458 election held for that purpose.
459459 Sec. 8356.152. OPERATION AND MAINTENANCE TAX. (a) If
460460 authorized at an election held under Section 8356.151, the district
461461 may impose an operation and maintenance tax on taxable property in
462462 the district in accordance with Section 49.107, Water Code.
463463 (b) The board shall determine the tax rate. The rate may not
464464 exceed the rate approved at the election.

475475 SUBCHAPTER E. BONDS AND OTHER OBLIGATIONS
476476 Sec. 8356.201. AUTHORITY TO ISSUE BONDS AND OTHER
477477 OBLIGATIONS. The district may issue bonds or other obligations
478478 payable wholly or partly from ad valorem taxes, impact fees,
479479 revenue, including revenue received by the district under Chapter
480480 311, Tax Code, and Chapter 380, Local Government Code, assessments,
481481 grants, or other district money, or any combination of those
482482 sources, to pay for any authorized district purpose.
483483 Sec. 8356.202. TAXES FOR BONDS. At the time the district
484484 issues bonds payable wholly or partly from ad valorem taxes, the
485485 board shall provide for the annual imposition of a continuing
486486 direct ad valorem tax, without limit as to rate or amount, while all
487487 or part of the bonds are outstanding as required and in the manner
488488 provided by Sections 54.601 and 54.602, Water Code.
489489 Sec. 8356.203. BONDS FOR ROAD PROJECTS. At the time of
490490 issuance, the total principal amount of bonds or other obligations
491491 issued or incurred to finance road projects and payable from ad
492492 valorem taxes may not exceed one-fourth of the assessed value of the
493493 real property in the district.
