55 relating to the Clear Creek Watershed Authority.
66 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
77 SECTION 1. Section 2a, Chapter 372, Acts of the 56th
88 Legislature, Regular Session, 1959, is amended to read as follows:
99 Sec. 2a. Notwithstanding the provisions of Section 2 of
1010 this Act, the Authority does not include within its boundaries any
1111 territory that is located within the incorporated limits of any
1212 municipality, as those incorporated limits existed on January 1,
1313 2009 [city].
1414 SECTION 2. Section 9006.004, Special District Local Laws
1515 Code, is amended by adding Subsection (c) to read as follows:
1616 (c) Territory in the authority that is annexed by a
1717 municipality on or after January 1, 2009, remains in the authority.
1818 SECTION 3. Section 9006.207, Special District Local Laws
1919 Code, is amended to read as follows:
2020 Sec. 9006.207. AUTHORITY PROPERTY NOT SUBJECT TO TAXATION.
2121 Property owned by the [The] authority is exempt from [liable for] ad
2222 valorem taxes imposed by a county, municipality, [or] school
2323 district, or other entity [on property owned by the authority].
2424 SECTION 4. (a) All governmental acts and proceedings of
2525 the Clear Creek Watershed Authority that were taken before the
2626 effective date of this Act are validated, ratified, and confirmed
2727 in all respects as if they had been taken as authorized by law.
2828 (b) This section does not apply to any matter that on the
2929 effective date of this Act:
3030 (1) is involved in litigation if the litigation
3131 ultimately results in the matter being held invalid by a final court
3232 judgment; or
3333 (2) has been held invalid by a final court judgment.
3434 SECTION 5. (a) The legal notice of the intention to
3535 introduce this Act, setting forth the general substance of this
3636 Act, has been published as provided by law, and the notice and a
3737 copy of this Act have been furnished to all persons, agencies,
3838 officials, or entities to which they are required to be furnished
3939 under Section 59, Article XVI, Texas Constitution, and Chapter 313,
4040 Government Code.
4141 (b) The governor, one of the required recipients, has
4242 submitted the notice and Act to the Texas Commission on
4343 Environmental Quality.
4444 (c) The Texas Commission on Environmental Quality has filed
4545 its recommendations relating to this Act with the governor, the
4646 lieutenant governor, and the speaker of the house of
4747 representatives within the required time.
4848 (d) All requirements of the constitution and laws of this
4949 state and the rules and procedures of the legislature with respect
5050 to the notice, introduction, and passage of this Act are fulfilled
5151 and accomplished.
5252 SECTION 6. This Act takes effect immediately if it receives
5353 a vote of two-thirds of all the members elected to each house, as
5454 provided by Section 39, Article III, Texas Constitution. If this
5555 Act does not receive the vote necessary for immediate effect, this
5656 Act takes effect September 1, 2009.
