88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Subsections (a) and (c), Section 8801.204,
1010 Special District Local Laws Code, are amended to read as follows:
1111 (a) If it appears that a person has violated or is violating
1212 or threatening to violate this chapter or a rule, permit, or other
1313 order of the district issued or adopted under this chapter, the
1414 district may institute an action in a district court in the district
1515 for:
1616 (1) injunctive relief to restrain the person from
1717 continuing the violation or threat of violation;
1818 (2) the assessment and recovery of a civil penalty of:
1919 (A) not less than $50 and not more than $5,000 for
2020 each violation and for each day of a continuing violation, if the
2121 person is not a political subdivision or an agency of a political
2222 subdivision; or
2323 (B) if the person is a political subdivision or
2424 an agency of a political subdivision, an amount equal to the greater
2525 of:
2626 (i) 120 percent of the sum of the fees
2727 assessed against the person and the amount the person would have
2828 paid to an alternative water supplier; or
2929 (ii) $5,000 for each violation and for each
3030 day of a continuing violation; or
3131 (3) both injunctive relief and civil penalties.
3232 (c) At the request of the board, or the general manager if
3333 authorized by the board, the attorney general shall institute and
3434 conduct an action against any person in the name of the district for
3535 injunctive relief or to recover a civil penalty, or both.
3636 SECTION 2. Subsections (a) and (b), Section 43, Chapter
3737 1045, Acts of the 71st Legislature, Regular Session, 1989, are
3838 amended to read as follows:
3939 (a) If a person has violated, is violating, or is
4040 threatening to violate a provision of this Act or a rule,
4141 regulation, permit, or other order of the district, the district
4242 may bring a civil action in a district court within the district
4343 for:
4444 (1) an injunction to restrain the person from
4545 continuing the violation or the threat of violation;
4646 (2) the assessment and recovery of[, for] a civil
4747 penalty of:
4848 (A) not less than $50 nor more than $5,000 for
4949 each violation and for each day of violation, if the person is not a
5050 political subdivision or an agency of a political subdivision; or
5151 (B) if the person is a political subdivision or
5252 an agency of a political subdivision, an amount equal to the greater
5353 of:
5454 (i) 120 percent of the sum of the fees
5555 assessed against the person and the amount the person would have
5656 paid to an alternative water supplier; or
5757 (ii) $5,000 for each violation and for each
5858 day of a continuing violation; or
5959 (3) [for] both injunctive relief and civil penalty.
6060 (b) At the request of the board, or the general manager if
6161 authorized by the board, the attorney general shall institute and
6262 conduct an [the] action against any person in the name of the
6363 district for injunctive relief or to recover a civil penalty, or
6464 both. However, the district in its sole discretion may employ
6565 attorneys of its choice to institute the action.
6666 SECTION 3. The changes in law made by this Act apply only to
6767 a violation that occurs on or after the effective date of this Act.
6868 A violation that occurs before the effective date of this Act is
6969 governed by the law in effect at the time the violation occurred,
7070 and the former law is continued in effect for that purpose.
7171 SECTION 4. This Act takes effect immediately if it receives
7272 a vote of two-thirds of all the members elected to each house, as
7373 provided by Section 39, Article III, Texas Constitution. If this
7474 Act does not receive the vote necessary for immediate effect, this
7575 Act takes effect September 1, 2009.
