55 AN ACT
66 relating to the review of information technology systems used by a
77 state agency for compatibility with open standards.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 441.203, Government Code, is amended by
1010 adding Subsection (m) to read as follows:
1111 (m) The council, in cooperation with the Department of
1212 Information Resources, shall:
1313 (1) review each state agency's existing information
1414 technology system to determine whether the system is compatible
1515 with open standards; and
1616 (2) consult with and provide assistance to state
1717 agencies on:
1818 (A) enhancing the state agency's information
1919 technology system to achieve compatibility with open standards
2020 where appropriate; and
2121 (B) identifying and recommending information
2222 technology systems that are compatible with open standards and
2323 recognized best practices, including:
2424 (i) open standards for document formats for
2525 creating, exchanging, and maintaining electronic texts,
2626 presentations, and spreadsheets, to replace outdated systems that
2727 are to be retired or upgraded;
2828 (ii) open standards for database systems
2929 based on the Structured Query Language (SQL) standard defined by
3030 the American National Standards Institute (ANSI), to replace
3131 outdated systems based on nonrelational database technologies that
3232 are to be retired or upgraded;
3333 (iii) recognized best practices for the
3434 structuring of data held in databases or disk file systems used by
3535 mission-critical transaction processing applications, such that
3636 the data is held in normalized relational data tables, to replace
3737 outdated methods of data organization based on nonrelational or
3838 highly nonnormalized data models, other than data warehouses and
3939 business intelligence applications, that are to be retired or
4040 upgraded;
4141 (iv) open standards for computer
4242 programming languages used for the development and maintenance of
4343 applications, such that the programming languages used shall
4444 conform to standards recognized by national or international
4545 standards bodies, to replace applications developed in outdated
4646 programming languages that are to be retired or upgraded; and
4747 (v) open standards for operating system
4848 hardware interface layers, such that operating systems used in
4949 mission-critical applications are not tied exclusively to a single
5050 brand of computer hardware or to a single type of microprocessor, to
5151 replace outdated systems that are to be retired or updated.
5252 SECTION 2. This Act takes effect immediately if it receives
5353 a vote of two-thirds of all the members elected to each house, as
5454 provided by Section 39, Article III, Texas Constitution. If this
5555 Act does not receive the vote necessary for immediate effect, this
5656 Act takes effect September 1, 2009.
