| 7 | 7 | | relating to the qualifications for office of justice of the peace in |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter A, Chapter 27, Government Code, is |
|---|
| 11 | 11 | | amended by adding Section 27.0055 to read as follows: |
|---|
| 12 | 12 | | Sec. 27.0055. QUALIFICATIONS OF JUSTICES OF CERTAIN |
|---|
| 13 | 13 | | COUNTIES. A justice of the peace in a county with a population of |
|---|
| 14 | 14 | | 200,000 or more must be: |
|---|
| 15 | 15 | | (1) at least 25 years of age; and |
|---|
| 16 | 16 | | (2) licensed to practice law in this state. |
|---|
| 17 | 17 | | SECTION 2. The change in law made by this Act applies only |
|---|
| 18 | 18 | | to a justice of the peace elected or appointed on or after the |
|---|
| 19 | 19 | | effective date of this Act. A justice of the peace elected or |
|---|
| 20 | 20 | | appointed before the effective date of this Act is governed by the |
|---|
| 21 | 21 | | law in effect immediately before the effective date of this Act |
|---|
| 22 | 22 | | until the term for which the justice was elected or appointed |
|---|
| 23 | 23 | | expires or the justice is otherwise removed as provided by law, and |
|---|
| 24 | 24 | | the former law is continued in effect for that purpose. |

| 25 | 25 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 26 | 26 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 27 | 27 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 28 | 28 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 29 | 29 | | Act takes effect September 1, 2009. |
