55 AN ACT
66 relating to the tuition rebate program for certain undergraduate
77 students at general academic teaching institutions.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 54.0065, Education Code, is amended by
1010 amending Subsection (b) and adding Subsections (b-1), (b-2), (j),
1111 and (k) to read as follows:
1212 (b) Except as provided by Subsections (b-1) and (b-2), the
1313 [The] amount of tuition to be rebated to a student graduating in an
1414 academic year [under this section] is the amount certified for that
1515 academic year to the governing board of the general academic
1616 teaching institution by the Texas Higher Education Coordinating
1717 Board under this section.
1818 (b-1) The amount of tuition to be rebated to a student is two
1919 times the certified amount if the student satisfies the
2020 requirements of this section in three years or less.
2121 (b-2) If [$1,000, unless] the total amount of undergraduate
2222 tuition paid by the student to the general academic teaching
2323 institution [of higher education] awarding the degree was less than
2424 the full amount of rebate under Subsection (b) or (b-1), as
2525 applicable, [$1,000, in which event] the amount of tuition to be
2626 rebated is an amount equal to the amount of undergraduate tuition
2727 paid by the student to the institution. However, the [a] student
2828 [who paid the institution awarding the degree an amount of
2929 undergraduate tuition less than $1,000] may qualify for an increase
3030 in the amount of the rebate, not to exceed the applicable amount
3131 under Subsection (b) or (b-1) [a total rebate of $1,000], for any
3232 amount of undergraduate tuition the student paid to other
3333 institutions of higher education by providing the institution with
3434 proof of the total amount of that tuition paid to other institutions
3535 of higher education.
3636 (j) Not later than August 15 of each academic year, the
3737 coordinating board shall determine and certify to the governing
3838 board of each general academic teaching institution the amount of
3939 tuition to be rebated by that institution under Subsection (b) to
4040 each student graduating in the next academic year. The amount
4141 certified must equal the rebate amount certified in the preceding
4242 academic year to the general academic teaching institution under
4343 this subsection for rebates awarded under Subsection (b) in the
4444 current academic year, increased by a percentage, expressed in
4545 decimal form rounded to the nearest hundredth, that equals the
4646 percentage by which that institution has increased from the current
4747 academic year to the next academic year the total amount of tuition
4848 charged under Section 54.0513 or another law authorizing the
4949 institution to establish tuition rates.
5050 (k) Notwithstanding Subsection (j), not later than October
5151 31, 2009, the coordinating board shall determine and certify to the
5252 governing board of each general academic teaching institution the
5353 amount of tuition to be rebated by that institution under
5454 Subsection (b) to students graduating in the 2009-2010 academic
5555 year. The amount certified must equal the full amount of a rebate
5656 authorized to be awarded by general academic teaching institutions
5757 under Subsection (b), as that subsection existed on January 1,
5858 2009, during the 2008-2009 academic year, increased by a
5959 percentage, expressed in decimal form rounded to the nearest
6060 hundredth, that equals the percentage by which the institution for
6161 which the certification is made has increased from the 2003-2004
6262 academic year to the 2009-2010 academic year the total amount of
6363 tuition charged under Section 54.0513 or another law authorizing
6464 the institution to establish tuition rates. For purposes of
6565 Subsection (j), the amount certified under this subsection is
6666 considered to have been certified under Subsection (j) on August
6767 15, 2009. This subsection expires January 1, 2011.
6868 SECTION 2. (a) The change in law made by this Act applies
6969 only to a student who is awarded a baccalaureate degree from a
7070 general academic teaching institution on or after September 1,
7171 2009.
7272 (b) The Texas Higher Education Coordinating Board may adopt
7373 rules under Section 54.0065, Education Code, as amended by this
7474 Act, for rebates awarded during the 2009-2010 academic year in the
7575 manner provided by law for the adoption of emergency rules.
7676 SECTION 3. This Act does not make an appropriation. This
7777 Act takes effect only if a specific appropriation for the
7878 implementation of the Act is provided in a general appropriations
7979 act of the 81st Legislature.
8080 SECTION 4. Except as provided by Section 3 of this Act, this
8181 Act takes effect immediately if it receives a vote of two-thirds of
8282 all the members elected to each house, as provided by Section 39,
8383 Article III, Texas Constitution. If this Act does not receive the
8484 vote necessary for immediate effect, this Act takes effect
8585 September 1, 2009, except as provided by Section 3 of this Act.
