6	6	relating to the tuition rebate program for certain undergraduate
7	7	students at general academic teaching institutions.
8	8	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
9	9	SECTION 1. Section 54.0065, Education Code, is amended by
10	10	amending Subsection (b) and adding Subsections (b-1), (b-2), (j),
11	11	and (k) to read as follows:
12	12	(b) Except as provided by Subsections (b-1) and (b-2), the
13	13	[The] amount of tuition to be rebated to a student graduating in an
14	14	academic year [under this section] is the amount certified for that
15	15	academic year to the governing board of the general academic
16	16	teaching institution by the Texas Higher Education Coordinating
17	17	Board under this section.
18	18	(b-1) The amount of tuition to be rebated to a student is two
19	19	times the certified amount if the student satisfies the
20	20	requirements of this section in three years or less.
21	21	(b-2) If [$1,000, unless] the total amount of undergraduate
22	22	tuition paid by the student to the general academic teaching
23	23	institution [of higher education] awarding the degree was less than
24	24	the full amount of rebate under Subsection (b) or (b-1), as
25	25	applicable, [$1,000, in which event] the amount of tuition to be
26	26	rebated is an amount equal to the amount of undergraduate tuition
27	27	paid by the student to the institution. However, the [a] student
28	28	[who paid the institution awarding the degree an amount of
29	29	undergraduate tuition less than $1,000] may qualify for an increase
30	30	in the amount of the rebate, not to exceed the applicable amount
31	31	under Subsection (b) or (b-1) [a total rebate of $1,000], for any
32	32	amount of undergraduate tuition the student paid to other
33	33	institutions of higher education by providing the institution with
34	34	proof of the total amount of that tuition paid to other institutions
35	35	of higher education.
36	36	(j) Not later than August 15 of each academic year, the
37	37	coordinating board shall determine and certify to the governing
38	38	board of each general academic teaching institution the amount of
39	39	tuition to be rebated by that institution under Subsection (b) to
40	40	each student graduating in the next academic year. The amount
41	41	certified must equal the rebate amount certified in the preceding
42	42	academic year to the general academic teaching institution under
43	43	this subsection for rebates awarded under Subsection (b) in the
44	44	current academic year, increased by a percentage, expressed in
45	45	decimal form rounded to the nearest hundredth, that equals the
46	46	percentage by which that institution has increased from the current
47	47	academic year to the next academic year the total amount of tuition
48	48	charged under Section 54.0513 or another law authorizing the
49	49	institution to establish tuition rates.
50	50	(k) Notwithstanding Subsection (j), not later than October
51	51	31, 2009, the coordinating board shall determine and certify to the
52	52	governing board of each general academic teaching institution the
53	53	amount of tuition to be rebated by that institution under
54	54	Subsection (b) to students graduating in the 2009-2010 academic
55	55	year. The amount certified must equal the full amount of a rebate
56	56	authorized to be awarded by general academic teaching institutions
57	57	under Subsection (b), as that subsection existed on January 1,
58	58	2009, during the 2008-2009 academic year, increased by a
59	59	percentage, expressed in decimal form rounded to the nearest
60	60	hundredth, that equals the percentage by which the institution for
61	61	which the certification is made has increased from the 2003-2004
62	62	academic year to the 2009-2010 academic year the total amount of
63	63	tuition charged under Section 54.0513 or another law authorizing
64	64	the institution to establish tuition rates. For purposes of
65	65	Subsection (j), the amount certified under this subsection is
66	66	considered to have been certified under Subsection (j) on August
67	67	15, 2009. This subsection expires January 1, 2011.
68	68	SECTION 2. (a) The change in law made by this Act applies
69	69	only to a student who is awarded a baccalaureate degree from a
70	70	general academic teaching institution on or after September 1,
71	71	2009.
72	72	(b) The Texas Higher Education Coordinating Board may adopt
73	73	rules under Section 54.0065, Education Code, as amended by this
74	74	Act, for rebates awarded during the 2009-2010 academic year in the
75	75	manner provided by law for the adoption of emergency rules.
76	76	SECTION 3. This Act does not make an appropriation. This
77	77	Act takes effect only if a specific appropriation for the
78	78	implementation of the Act is provided in a general appropriations
79	79	act of the 81st Legislature.
80	80	SECTION 4. Except as provided by Section 3 of this Act, this
81	81	Act takes effect immediately if it receives a vote of two-thirds of
82	82	all the members elected to each house, as provided by Section 39,
83	83	Article III, Texas Constitution. If this Act does not receive the
84	84	vote necessary for immediate effect, this Act takes effect
85	85	September 1, 2009, except as provided by Section 3 of this Act.
