55 AN ACT
66 relating to school district requirements regarding parental
77 notification and documentation in connection with disciplinary
88 alternative education programs.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 37.008, Education Code, is amended by
1111 adding Subsection (l-1) to read as follows:
1212 (l-1) A school district shall provide the parents of a
1313 student removed to a disciplinary alternative education program
1414 with written notice of the district's obligation under Subsection
1515 (l) to provide the student with an opportunity to complete
1616 coursework required for graduation. The notice must:
1717 (1) include information regarding all methods
1818 available for completing the coursework; and
1919 (2) state that the methods are available at no cost to
2020 the student.
2121 SECTION 2. Section 37.009, Education Code, is amended by
2222 adding Subsection (a-1) to read as follows:
2323 (a-1) A school principal or other appropriate administrator
2424 shall prepare and maintain documentation regarding each conference
2525 held under Subsection (a). The documentation must:
2626 (1) indicate the date and time the conference was
2727 held;
2828 (2) identify:
2929 (A) each person who attended the conference by
3030 name and profession; and
3131 (B) each person who failed to attend the
3232 conference after being requested to attend, including the reason
3333 for the failure to attend, if known; and
3434 (3) state the outcome of the conference.
3535 SECTION 3. This Act applies beginning with the 2009-2010
3636 school year.
3737 SECTION 4. This Act takes effect immediately if it receives
3838 a vote of two-thirds of all the members elected to each house, as
3939 provided by Section 39, Article III, Texas Constitution. If this
4040 Act does not receive the vote necessary for immediate effect, this
4141 Act takes effect September 1, 2009.
