 A BILL TO BE ENTITLED
 AN ACT
 relating to school district requirements regarding parental
 notification and documentation in connection with disciplinary
 alternative education programs.
 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 SECTION 1. Section 37.008, Education Code, is amended by
 adding Subsection (l-1) to read as follows:
 (l-1)  A school district shall provide the parents of a
 student removed to a disciplinary alternative education program
 with written notice of the district's obligation under Subsection
 (l) to provide the student with an opportunity to complete
 coursework required for graduation.  The notice must:
 (1)  include information regarding all methods
 available for completing the coursework; and
 (2)  state that the methods are available at no cost to
 the student.
 SECTION 2. Section 37.009, Education Code, is amended by
 adding Subsection (a-1) to read as follows:
 (a-1)  A school principal or other appropriate administrator
 shall prepare and maintain documentation regarding each conference
 held under Subsection (a).  The documentation must:
 (1)  indicate the date and time the conference was
 held;
 (2) identify:
 (A)  each person who attended the conference by
 name and profession; and
 (B)  each person who failed to attend the
 conference after being requested to attend, including the reason
 for the failure to attend, if known; and
 (3) state the outcome of the conference.
 SECTION 3. This Act applies beginning with the 2009-2010
 school year.
 SECTION 4. This Act takes effect immediately if it receives
 a vote of two-thirds of all the members elected to each house, as
 provided by Section 39, Article III, Texas Constitution. If this
 Act does not receive the vote necessary for immediate effect, this
 Act takes effect September 1, 2009.
