55 AN ACT
66 relating to the administrative fine and the late payment fee for a
77 violation of a parking rule applicable to the Capitol Complex.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Subsections (a), (b), and (d), Section 411.067,
1010 Government Code, are amended to read as follows:
1111 (a) The department may [shall have authority to] adopt rules
1212 for the assessment of an administrative fine of $25 [$10] for
1313 violations of the parking rules adopted under Section 411.063.
1414 Notwithstanding the provisions of Sections 411.065 and 411.066, the
1515 department may [in its discretion] issue an administrative citation
1616 for a parking violation.
1717 (b) Rules adopted under this section shall:
1818 (1) establish a system for enforcement of
1919 administrative citations, including [but not limited to]
2020 assessment of a late fee not to exceed $5 [$2] and towing,
2121 impoundment, or immobilization of vehicles; and
2222 (2) provide [for] a procedure of administrative review
2323 within the highway patrol district that includes the Capitol
2424 Complex [capitol police district] and, on request of the person
2525 assessed an administrative fine, further judicial review by the
2626 department filing the appropriate citation or complaint in a court
2727 [of competent jurisdiction], as provided in Section 411.066.
2828 (d) The department shall remit to the comptroller for
2929 deposit in the general revenue fund each [any] administrative fine
3030 and late fee collected [received] under this section. The money
3131 deposited [Such revenues] may be appropriated only to the
3232 department for [capitol police] security and parking in the highway
3333 patrol district that includes the Capitol Complex.
3434 SECTION 2. This Act takes effect September 1, 2009.
