99 AN ACT
1010 relating to abolishing the office of inspector of hides and
1111 animals.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. (a) The office of inspector of hides and
1414 animals is abolished.
1515 (b) Any records in the custody of an inspector of hides and
1616 animals are transferred to the county clerk of the county
1717 previously served by the inspector.
1818 SECTION 2. Subsection (e), Section 52.092, Election Code,
1919 is amended to read as follows:
2020 (e) County offices shall be listed in the following order:
2121 (1) county judge;
2222 (2) judge, county court at law;
2323 (3) judge, county criminal court;
2424 (4) judge, county probate court;
2525 (5) county attorney;
2626 (6) district clerk;
2727 (7) district and county clerk;
2828 (8) county clerk;
2929 (9) sheriff;
3030 (10) sheriff and tax assessor-collector;
3131 (11) county tax assessor-collector;
3232 (12) county treasurer;
3333 (13) county school trustee (county with population of
3434 3.3 million or more);
3535 (14) county surveyor[;
3636 [(15) inspector of hides and animals].
3737 SECTION 3. Subsection (a), Section 172.024, Election Code,
3838 is amended to read as follows:
3939 (a) The filing fee for a candidate for nomination in the
4040 general primary election is as follows:
4141 (1) United States senator $5,000
4242 (2) office elected statewide, except United States
4343 senator 3,750
4444 (3) United States representative 3,125
4545 (4) state senator 1,250
4646 (5) state representative 750
4747 (6) member, State Board of Education 300
4848 (7) chief justice or justice, court of appeals, other
4949 than a justice specified by Subdivision (8) 1,875
5050 (8) chief justice or justice of a court of appeals that
5151 serves a court of appeals district in which a county with a
5252 population of more than 750,000 is wholly or partly

8383 SECTION 4. Section 87.012, Local Government Code, is
8484 amended to read as follows:
8585 Sec. 87.012. OFFICERS SUBJECT TO REMOVAL. The district
8686 judge may, under this subchapter, remove from office:
8787 (1) a district attorney;
8888 (2) a county attorney;
8989 (3) a county judge;
9090 (4) a county commissioner;
9191 (5) a county clerk;
9292 (6) a district clerk;
9393 (7) a district and county clerk;
9494 (8) a county treasurer;
9595 (9) a sheriff;
9696 (10) a county surveyor;
9797 (11) a county tax assessor-collector;
9898 (12) a constable;
9999 (13) [an inspector of hides and animals;
100100 [(14)] a justice of the peace; and
101101 (14) [(15)] a county officer, not otherwise named by
102102 this section, whose office is created under the constitution or
103103 other law of this state.
104104 SECTION 5. Subsection (a), Section 87.041, Local Government
105105 Code, is amended to read as follows:
106106 (a) The commissioners court of a county may fill a vacancy
107107 in the office of:
108108 (1) county judge;
109109 (2) county clerk;
110110 (3) district and county clerk;
111111 (4) sheriff;
112112 (5) county attorney;
113113 (6) county treasurer;
114114 (7) county surveyor;
115115 (8) [inspector of hides and animals;
116116 [(9)] county tax assessor-collector;
117117 (9) [(10)] justice of the peace; or
118118 (10) [(11)] constable.
119119 SECTION 6. Sections 148.044, 148.067, and 148.068,
120120 Agriculture Code, are repealed.
121121 SECTION 7. This Act takes effect immediately if it receives
122122 a vote of two-thirds of all the members elected to each house, as
123123 provided by Section 39, Article III, Texas Constitution. If this
124124 Act does not receive the vote necessary for immediate effect, this
125125 Act takes effect September 1, 2009.
