99 relating to liability for failure to comply with a child support
1010 lien, court order, or notice of levy.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 157.324, Family Code, is amended to read
1313 as follows:
1414 Sec. 157.324. LIABILITY FOR FAILURE TO COMPLY WITH ORDER OR
1515 LIEN. (a) A person, other than a financial institution, who pays
1616 over, releases, sells, transfers, encumbers, conveys, or otherwise
1717 [knowingly] disposes of property subject to a child support lien or
1818 who, after a foreclosure hearing, fails to surrender on demand
1919 nonexempt personal property as directed by a court under this
2020 subchapter is liable to the claimant in an amount equal to the
2121 greater of three times the value of the property paid over,
2222 released, sold, transferred, encumbered, conveyed, or otherwise
2323 disposed of or not surrendered or $5,000, but not to exceed the
2424 amount of the child support arrearages for which the lien or
2525 foreclosure judgment was issued.
2626 (b) A financial institution that pays over, releases,
2727 sells, transfers, encumbers, conveys, or otherwise disposes of
2828 property subject to a child support lien or that, after a
2929 foreclosure hearing, fails to surrender on demand nonexempt
3030 personal property as directed by a court under this subchapter is
3131 liable to the claimant in an amount equal to the greater of one and
3232 one-half times the value of the property paid over, released, sold,
3333 transferred, encumbered, conveyed, or otherwise disposed of or not
3434 surrendered or $5,000, but not to exceed the amount of the child
3535 support arrearages for which the lien or foreclosure judgment was
3636 issued.
3737 (c) A claimant may recover costs and reasonable attorney's
3838 fees incurred in an action under this section.
3939 (d) Fifty percent of the amount paid to the claimant under
4040 Subsection (a) or (b) shall be credited against the child support
4141 arrearages owed by the obligor.
4242 (e) A financial institution is not liable under this section
4343 for the disposition of assets in an account if the child support
4444 lien does not contain either the account number or the social
4545 security number of an account owner of record.
4646 SECTION 2. Section 157.330, Family Code, is amended by
4747 amending Subsection (a) and adding Subsections (a-1), (c), and (d)
4848 to read as follows:
4949 (a) A person, other than a financial institution, who
5050 possesses or has a right to property that is the subject of a notice
5151 of levy delivered to the person and who refuses or fails to timely
5252 surrender the property or right to property that should have been
5353 paid or delivered to the claimant on demand is liable to the
5454 claimant in an amount equal to the greater of three times the value
5555 of the property or right to property that should have been paid or
5656 delivered or $5,000, [not surrendered] but [that does] not to
5757 exceed the amount of the child support arrearages for which the
5858 notice of levy has been filed.
5959 (a-1) A financial institution that possesses or has a right
6060 to property that is the subject of a notice of levy delivered to the
6161 financial institution and that refuses or fails to timely surrender
6262 the property or right to property that should have been paid or
6363 delivered to the claimant on demand is liable to the claimant in an
6464 amount equal to the greater of one and one-half times the value of
6565 the property or right to property that should have been paid or
6666 delivered or $5,000, but not to exceed the amount of the child
6767 support arrearages for which the notice of levy has been filed.
6868 (c) Fifty percent of the amount paid to the claimant under
6969 Subsection (a) or (a-1) shall be credited against the child support
7070 arrearages owed by the obligor.
7171 (d) A financial institution is not liable under this section
7272 for the disposition of assets in an account if the notice of levy
7373 does not contain either the account number or the social security
7474 number of an account owner of record.
7575 SECTION 3. This Act takes effect September 1, 2009.
