7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

8 | 8 | | SECTION 1. Section 142.001, Education Code, is amended by |
---|
9 | 9 | | amending Subdivision (3) and adding Subdivision (3-a) to read as |
---|
10 | 10 | | follows: |
---|
11 | 11 | | (3) "Eligible institution" means an institution of |
---|
12 | 12 | | higher education[, as defined by Section 61.003(8) of this code]. |
---|
13 | 13 | | (3-a) "Institution of higher education" and "medical |
---|
14 | 14 | | and dental unit" have the meanings assigned by Section 61.003. |
---|
15 | 15 | | SECTION 2. Section 142.002, Education Code, is amended to |
---|
16 | 16 | | read as follows: |
---|
17 | 17 | | Sec. 142.002. PURPOSE. The advanced research program is |
---|
18 | 18 | | established to encourage and provide support for basic research |
---|
19 | 19 | | conducted by faculty members and students in astronomy, atmospheric |
---|
20 | 20 | | science, biological and behavioral sciences, chemistry, computer |
---|
21 | 21 | | sciences, earth sciences, engineering, information science, |
---|
22 | 22 | | mathematics, material sciences, oceanography, physics, |
---|
23 | 23 | | environmental issues affecting the Texas-Mexico border region, the |
---|
24 | 24 | | reduction of industrial, agricultural, and domestic water use, |
---|
25 | 25 | | social sciences, and related disciplines in eligible institutions. |
---|
26 | 26 | | SECTION 3. Subsection (c), Section 142.003, Education Code, |
---|
27 | 27 | | is amended to read as follows: |
---|
28 | 28 | | (c) The guidelines and procedures developed by the |
---|
29 | 29 | | coordinating board must: |
---|
30 | 30 | | (1) provide for awards on a competitive, peer review |
---|
31 | 31 | | basis for specific projects at eligible institutions; and |
---|
32 | 32 | | (2) require that, as a condition of receiving an |
---|
33 | 33 | | award, an eligible institution must use a portion of the award to |
---|
34 | 34 | | support, in connection with the project for which the award is made, |
---|
35 | 35 | | basic research conducted by: |
---|
36 | 36 | | (A) graduate or undergraduate students, if the |
---|
37 | 37 | | eligible institution is a medical and dental unit; or |
---|
38 | 38 | | (B) undergraduate students, if the eligible |
---|
39 | 39 | | institution is any other institution of higher education. |
---|
40 | 40 | | SECTION 4. This Act takes effect immediately if it receives |
---|
41 | 41 | | a vote of two-thirds of all the members elected to each house, as |
---|
42 | 42 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
43 | 43 | | Act does not receive the vote necessary for immediate effect, this |
---|
44 | 44 | | Act takes effect September 1, 2009. |
