44 AN ACT
55 relating to the participation of students in funding awarded under
66 the advanced research program.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Section 142.001, Education Code, is amended by
99 amending Subdivision (3) and adding Subdivision (3-a) to read as
1010 follows:
1111 (3) "Eligible institution" means an institution of
1212 higher education[, as defined by Section 61.003(8) of this code].
1313 (3-a) "Institution of higher education" and "medical
1414 and dental unit" have the meanings assigned by Section 61.003.
1515 SECTION 2. Section 142.002, Education Code, is amended to
1616 read as follows:
1717 Sec. 142.002. PURPOSE. The advanced research program is
1818 established to encourage and provide support for basic research
1919 conducted by faculty members and students in astronomy, atmospheric
2020 science, biological and behavioral sciences, chemistry, computer
2121 sciences, earth sciences, engineering, information science,
2222 mathematics, material sciences, oceanography, physics,
2323 environmental issues affecting the Texas-Mexico border region, the
2424 reduction of industrial, agricultural, and domestic water use,
2525 social sciences, and related disciplines in eligible institutions.
2626 SECTION 3. Subsection (c), Section 142.003, Education Code,
2727 is amended to read as follows:
2828 (c) The guidelines and procedures developed by the
2929 coordinating board must:
3030 (1) provide for awards on a competitive, peer review
3131 basis for specific projects at eligible institutions; and
3232 (2) require that, as a condition of receiving an
3333 award, an eligible institution must use a portion of the award to
3434 support, in connection with the project for which the award is made,
3535 basic research conducted by:
3636 (A) graduate or undergraduate students, if the
3737 eligible institution is a medical and dental unit; or
3838 (B) undergraduate students, if the eligible
3939 institution is any other institution of higher education.
4040 SECTION 4. This Act takes effect immediately if it receives
4141 a vote of two-thirds of all the members elected to each house, as
4242 provided by Section 39, Article III, Texas Constitution. If this
4343 Act does not receive the vote necessary for immediate effect, this
4444 Act takes effect September 1, 2009.
