77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Section 481.102, Health and Safety Code, is

1010 Sec. 481.102. PENALTY GROUP 1. Penalty Group 1 consists of:

323323 (2) a material, compound, mixture, or preparation that
324324 contains any quantity of the following substances having a
325325 potential for abuse associated with a depressant effect on the
326326 central nervous system:
327327 a substance that contains any quantity of a
328328 derivative of barbituric acid, or any salt of a derivative of
329329 barbituric acid not otherwise described by this subsection;
330330 a compound, mixture, or preparation containing
331331 amobarbital, secobarbital, pentobarbital, or any salt of any of
332332 these, and one or more active medicinal ingredients that are not
333333 listed in any penalty group;
334334 a suppository dosage form containing amobarbital,
335335 secobarbital, pentobarbital, or any salt of any of these drugs, and
336336 approved by the United States Food and Drug Administration for
337337 marketing only as a suppository;

412412 quantity of an isoquinoline alkaloid of opium;

416416 nonnarcotic ingredients in recognized therapeutic amounts;

419419 dosage unit, with one or more active, nonnarcotic ingredients in
420420 recognized therapeutic amounts;
421421 not more than 300 milligrams of ethylmorphine, or

423423 per dosage unit, with one or more active, nonnarcotic ingredients

448448 (6) Peyote, unless unharvested and growing in its
449449 natural state, meaning all parts of the plant classified
450450 botanically as Lophophora, whether growing or not, the seeds of the
451451 plant, an extract from a part of the plant, and every compound,
452452 manufacture, salt, derivative, mixture, or preparation of the
453453 plant, its seeds, or extracts;
454454 (7) unless listed in another penalty group, a
455455 material, compound, mixture, or preparation that contains any
456456 quantity of the following substances having a stimulant effect on
457457 the central nervous system, including the substance's salts,
458458 optical, position, or geometric isomers, and salts of the
459459 substance's isomers, if the existence of the salts, isomers, and

548548 SECTION 4. The change in law made by this Act applies only

553553 this section, an offense was committed before the effective date of
554554 this Act if any element of the offense was committed before that
555555 date.
556556 SECTION 5. This Act takes effect September 1, 2009.
