| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Subchapter D, Chapter 54, Education Code, is |
|---|
| 10 | 10 | | amended by adding Section 54.224 to read as follows: |
|---|
| 11 | 11 | | Sec. 54.224. INTERINSTITUTIONAL ACADEMIC PROGRAMS. |
|---|
| 12 | 12 | | (a) In this section: |
|---|
| 13 | 13 | | (1) "Interinstitutional academic program" means a |
|---|
| 14 | 14 | | program under which a student may, in accordance with a written |
|---|
| 15 | 15 | | agreement between an institution of higher education and one or |
|---|
| 16 | 16 | | more other institutions of higher education or private or |
|---|
| 17 | 17 | | independent institutions of higher education, take courses at each |
|---|
| 18 | 18 | | institution that is a party to the agreement as necessary to fulfill |
|---|
| 19 | 19 | | the program's degree or certificate requirements. |
|---|
| 20 | 20 | | (2) "Private or independent institution of higher |
|---|
| 21 | 21 | | education" has the meaning assigned by Section 61.003. |
|---|
| 22 | 22 | | (b) Notwithstanding any other provision of this chapter, |
|---|
| 23 | 23 | | the governing board of an institution of higher education may |
|---|
| 24 | 24 | | exempt from the payment of tuition and required fees authorized by |
|---|
| 25 | 25 | | this chapter a student who is taking a course, including an |
|---|
| 26 | 26 | | interdisciplinary course, at the institution under an |
|---|
| 27 | 27 | | interinstitutional academic program agreement but who is enrolled |
|---|
| 28 | 28 | | primarily at another institution of higher education or at a |
|---|
| 29 | 29 | | private or independent institution of higher education that is a |
|---|
| 30 | 30 | | party to the agreement and to which the student is responsible for |
|---|
| 31 | 31 | | the payment of tuition and fees. |
|---|
| 32 | 32 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 33 | 33 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 34 | 34 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 35 | 35 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 36 | 36 | | Act takes effect September 1, 2009. |
