8 | 8 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
9 | 9 | SECTION 1. Section 545.060, Transportation Code, is amended | |
10 | 10 | by amending Subsection (a) and adding Subsection (e) to read as | |
11 | 11 | follows: | |
12 | 12 | (a) An operator on a roadway divided into two or more | |
13 | 13 | clearly marked lanes for traffic: | |
14 | 14 | (1) shall drive as nearly as practical entirely within | |
15 | 15 | a single lane, except as provided by Subsection (e); and | |
16 | 16 | (2) may not move from the lane unless that movement can | |
17 | 17 | be made safely. | |
18 | 18 | (e) The operator of a motorcycle may operate the motorcycle | |
19 | 19 | for a safe distance between lanes of traffic moving in the same | |
20 | 20 | direction during periods of traffic congestion if: | |
21 | 21 | (1) notwithstanding Section 661.003(c), the operator | |
22 | 22 | and any passenger wear protective headgear that meets the safety | |
23 | 23 | standards adopted by the department; and | |
24 | 24 | (2) the operator operates the motorcycle: | |
25 | 25 | (A) at a speed not more than five miles per hour | |
26 | 26 | greater than the speed of the other traffic; | |
27 | 27 | (B) in traffic that is moving at a speed of 20 | |
28 | 28 | miles per hour or less; and | |
29 | 29 | (C) in a location other than a school crossing | |
30 | 30 | zone or a location where the posted speed limit is 20 miles per hour | |
31 | 31 | or less. | |
32 | 32 | SECTION 2. This Act takes effect September 1, 2009. |
