55 AN ACT
66 relating to the operation and movement of motorcycles during
77 periods of traffic congestion.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 545.060, Transportation Code, is amended
1010 by amending Subsection (a) and adding Subsection (e) to read as
1111 follows:
1212 (a) An operator on a roadway divided into two or more
1313 clearly marked lanes for traffic:
1414 (1) shall drive as nearly as practical entirely within
1515 a single lane, except as provided by Subsection (e); and
1616 (2) may not move from the lane unless that movement can
1717 be made safely.
1818 (e) The operator of a motorcycle may operate the motorcycle
1919 for a safe distance between lanes of traffic moving in the same
2020 direction during periods of traffic congestion if:
2121 (1) notwithstanding Section 661.003(c), the operator
2222 and any passenger wear protective headgear that meets the safety
2323 standards adopted by the department; and
2424 (2) the operator operates the motorcycle:
2525 (A) at a speed not more than five miles per hour
2626 greater than the speed of the other traffic;
2727 (B) in traffic that is moving at a speed of 20
2828 miles per hour or less; and
2929 (C) in a location other than a school crossing
3030 zone or a location where the posted speed limit is 20 miles per hour
3131 or less.
3232 SECTION 2. This Act takes effect September 1, 2009.
