55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to health education curriculum and instruction in public
88 schools.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. This Act may be cited as the Texas Education
1111 Works Act.
1212 SECTION 2. Section 28.004, Education Code, is amended by
1313 amending Subsection (e) and adding Subsection (m) to read as
1414 follows:
1515 (e) Any course materials and instruction relating to human
1616 sexuality, sexually transmitted diseases, or human
1717 immunodeficiency virus or acquired immune deficiency syndrome
1818 shall be selected by the board of trustees with the advice of the
1919 local school health advisory council and must:
2020 (1) present medically accurate and age-appropriate
2121 information;
2222 (2) present abstinence from sexual activity as the
2323 preferred choice of behavior in relationship to all sexual activity
2424 for unmarried persons of school age;
2525 [(2) devote more attention to abstinence from sexual
2626 activity than to any other behavior;]
2727 (3) emphasize that abstinence from sexual activity, if
2828 used consistently and correctly, is the only method that is 100
2929 percent effective in preventing pregnancy, sexually transmitted
3030 diseases, sexually transmitted infection with human
3131 immunodeficiency virus, and [or] acquired immune deficiency
3232 syndrome resulting from sexual activity[, and the emotional trauma
3333 associated with adolescent sexual activity];
3434 (4) direct adolescents to a standard of behavior in
3535 which abstinence from sexual activity before marriage is the most
3636 effective way to prevent pregnancy, sexually transmitted diseases,
3737 sexually transmitted [and] infection with human immunodeficiency
3838 virus, and [or] acquired immune deficiency syndrome resulting from
3939 sexual activity; [and]
4040 (5) provide information about the health benefits,
4141 effectiveness, and safety of methods approved by the United States
4242 Food and Drug Administration for reducing the risk of contracting
4343 sexually transmitted diseases;
4444 (6) provide information about the health benefits,
4545 effectiveness, and safety in preventing pregnancy of all
4646 contraceptive methods approved by the United States Food and Drug
4747 Administration;
4848 (7) provide information on local resources for testing
4949 for and obtaining medical care for sexually transmitted diseases;
5050 (8) include strategies to promote effective
5151 communication between adolescents and their parents and other
5252 family members about human sexuality;
5353 (9) address the economic and emotional requirements of
5454 parenthood;
5555 (10) encourage students to develop healthy life
5656 skills, including goal setting, decision making, refusal and
5757 negotiation, and effective communication;
5858 (11) teach skills for making responsible decisions
5959 about sexual activity, including how to avoid unwanted verbal or
6060 physical sexual advances and how to avoid making unwanted verbal or
6161 physical sexual advances;
6262 (12) teach how drug and alcohol use may affect
6363 responsible decision making; and
6464 (13) help students develop healthy attitudes and
6565 values concerning growth and development, body image, and
6666 relationships [teach contraception and condom use in terms of human
6767 use reality rates instead of theoretical laboratory rates, if
6868 instruction on contraception and condoms is included in curriculum
6969 content].
7070 (m) In this section:
7171 (1) "Age-appropriate information" means information,
7272 including topics, messages, and teaching methods, that is suitable
7373 for the particular ages or age groups of children and adolescents to
7474 whom the information is to be presented based on the developing
7575 cognitive, emotional, and behavioral capacity of children or
7676 adolescents of that age or age group.
7777 (2) "Medically accurate information" means
7878 information that is:
7979 (A) verified or supported by the weight of
8080 research conducted in compliance with accepted scientific methods;
8181 (B) published in peer reviewed journals, if
8282 appropriate; and
8383 (C) recognized as accurate, objective, and
8484 complete by mainstream professional organizations and agencies
8585 with expertise in the relevant field, including:
8686 (i) the Centers for Disease Control and
8787 Prevention;
8888 (ii) the American College of Obstetricians
8989 and Gynecologists;
9090 (iii) the American Academy of Pediatrics;
9191 (iv) the American Public Health
9292 Association;
9393 (v) the American Academy of Family
9494 Physicians;
9595 (vi) the Infectious Diseases Society of
9696 America; and
9797 (vii) the American Psychological
9898 Association.
9999 SECTION 3. (a) A school district that uses textbooks or
100100 other course materials that do not reflect the requirements
101101 prescribed by Section 28.004(e), Education Code, as amended by this
102102 Act, shall also use appropriate supplemental instructional
103103 materials as necessary to comply with those requirements.
104104 (b) A school district that permits a person not employed by
105105 the district to present one or more components of the district's
106106 human sexuality instruction must require the person to comply with
107107 the requirements prescribed by Section 28.004(e), Education Code,
108108 as amended by this Act.
109109 SECTION 4. This Act applies beginning with the 2009-2010
110110 school year.
111111 SECTION 5. This Act takes effect immediately if it receives
112112 a vote of two-thirds of all the members elected to each house, as
113113 provided by Section 39, Article III, Texas Constitution. If this
114114 Act does not receive the vote necessary for immediate effect, this
115115 Act takes effect September 1, 2009.
