7 | 7 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
8 | 8 | SECTION 1. Article 45.056, Code of Criminal Procedure, is | |
9 | 9 | amended by adding Subsection (f) to read as follows: | |
10 | 10 | (f) The judge of a court that employs a juvenile case | |
11 | 11 | manager under Subsection (a) or (c) shall supervise the juvenile | |
12 | 12 | case manager, except that the judge may delegate that duty to | |
13 | 13 | another officer of the court who is authorized to conduct hearings | |
14 | 14 | under Title 3, Family Code. The judge may not delegate that duty to | |
15 | 15 | the clerk of the court. This subsection does not apply to: | |
16 | 16 | (1) a part-time judge; or | |
17 | 17 | (2) a county court for which the county judge has | |
18 | 18 | appointed one or more full-time magistrates under Section 54.1172, | |
19 | 19 | Government Code. | |
20 | 20 | SECTION 2. Subsection (f), Article 45.056, Code of Criminal | |
21 | 21 | Procedure, as added by this Act, applies to the supervision of a | |
22 | 22 | juvenile case manager employed by a court on or after the effective | |
23 | 23 | date of this Act, regardless of whether the juvenile case manager | |
24 | 24 | began that employment before, on, or after the effective date of | |
25 | 25 | this Act. | |
26 | 26 | SECTION 3. This Act takes effect September 1, 2009. |
