| 7 | 7 | | relating to a school district policy concerning the use of school |
|---|
| 8 | 8 | | counselors' work time. |
|---|
| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 33.006, Education Code, is amended by |
|---|
| 11 | 11 | | adding Subsection (c) to read as follows: |
|---|
| 12 | 12 | | (c) In accordance with rules adopted by the commissioner, |
|---|
| 13 | 13 | | the board of trustees of each school district shall adopt a policy |
|---|
| 14 | 14 | | that requires a counselor to spend not more than 10 percent of the |
|---|
| 15 | 15 | | counselor's total work time on duties that are not components of a |
|---|
| 16 | 16 | | counseling or guidance program developed under Section 33.005. For |
|---|
| 17 | 17 | | purposes of this subsection, time spent in administering assessment |
|---|
| 18 | 18 | | instruments or providing other assistance in connection with |
|---|
| 19 | 19 | | assessment instruments, except time spent in interpreting data from |
|---|
| 20 | 20 | | assessment instruments, is not considered time spent on counseling |
|---|
| 21 | 21 | | or guidance. Each school in the district shall implement the |
|---|
| 22 | 22 | | policy. A copy of the policy shall be maintained in the office of |
|---|
| 23 | 23 | | each school in the district and made available on request during |
|---|
| 24 | 24 | | regular school hours to district employees, parents of district |
|---|
| 25 | 25 | | students, and the public. |

| 26 | 26 | | SECTION 2. Section 39.074, Education Code, is amended by |
|---|
| 27 | 27 | | adding Subsection (g) to read as follows: |
|---|
| 28 | 28 | | (g) Before an investigation, the commissioner shall request |
|---|
| 29 | 29 | | that the district scheduled for the investigation assess the |
|---|
| 30 | 30 | | district's compliance with the policy adopted under Section |
|---|
| 31 | 31 | | 33.006(c) and provide a written copy of the assessment to the |
|---|
| 32 | 32 | | investigators on or before the date specified by the commissioner. |
|---|
| 33 | 33 | | As part of each investigation, the investigators shall interview a |
|---|
| 34 | 34 | | percentage of district counselors determined by the commissioner to |
|---|
| 35 | 35 | | assess the district's compliance with the policy adopted under |
|---|
| 36 | 36 | | Section 33.006(c). The commissioner shall adopt rules to implement |
|---|
| 37 | 37 | | this subsection. |
|---|
| 38 | 38 | | SECTION 3. (a) Each school district shall implement a |
|---|
| 39 | 39 | | policy adopted under Subsection (c), Section 33.006, Education |
|---|
| 40 | 40 | | Code, as added by this Act, beginning with the 2009-2010 school |
|---|
| 41 | 41 | | year. |
|---|
| 42 | 42 | | (b) Subsection (g), Section 39.074, Education Code, as |
|---|
| 43 | 43 | | added by this Act, applies beginning with the 2009-2010 school |
|---|
| 44 | 44 | | year. |
|---|
| 45 | 45 | | SECTION 4. This Act takes effect immediately if it receives |
|---|
| 46 | 46 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 47 | 47 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 48 | 48 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 49 | 49 | | Act takes effect September 1, 2009. |
