7 | 7 | relating to an exception to the purchase of a refrigerant or | |
8 | 8 | equipment containing a refrigerant. | |
9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Section 1302.453(b), Occupations Code, is | |
11 | 11 | amended to read as follows: | |
12 | 12 | (b) It is an exception to the application of this section | |
13 | 13 | with respect to a purchase of a refrigerant or equipment containing | |
14 | 14 | a refrigerant in this state in violation of Section 1302.356(1) | |
15 | 15 | [1302.356] that: | |
16 | 16 | (1) the refrigerant or equipment is purchased for use | |
17 | 17 | in a commercial or residential air conditioning system that | |
18 | 18 | requires 15 pounds or less of refrigerant; or | |
19 | 19 | (2) the refrigerant or equipment is purchased for use | |
20 | 20 | only in a motor vehicle and that use is authorized by the United | |
21 | 21 | States Environmental Protection Agency. | |
22 | 22 | SECTION 2. The change in law made by this Act applies only | |
23 | 23 | to an offense committed on or after the effective date of this Act. | |
24 | 24 | An offense committed before the effective date of this Act is | |
25 | 25 | covered by the law in effect when the offense was committed, and the | |
26 | 26 | former law is continued in effect for that purpose. For purposes of | |
27 | 27 | this section, an offense was committed before the effective date of | |
28 | 28 | this Act if any element of the offense occurred before that date. | |
29 | 29 | SECTION 3. This Act takes effect September 1, 2009. |
