55 relating to notification to a patient of a state-operated mental
66 health facility or resident of a residential care facility of the
77 exemption of certain trusts from liability to pay for support.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Subchapter A, Chapter 576, Health and Safety
1010 Code, is amended by adding Section 576.010 to read as follows:
1111 Sec. 576.010. NOTIFICATION OF TRUST EXEMPTION. (a) At the
1212 time a patient is admitted to an inpatient mental health facility
1313 for voluntary or involuntary inpatient mental health services, the
1414 facility shall provide to the patient, and the parent if the patient
1515 is a minor or the guardian of the person of the patient, written
1616 notice, in the person's primary language, that a trust that
1717 qualifies under Section 552.018 is not liable for the patient's
1818 support. In addition, the facility shall ensure that, within 24
1919 hours after the patient is admitted to the facility, the
2020 notification is explained to the patient:
2121 (1) orally, in simple, nontechnical terms in the
2222 patient's primary language, if possible; or
2323 (2) through a means reasonably calculated to
2424 communicate with a patient who has an impairment of vision or
2525 hearing, if applicable.
2626 (b) Notice required under Subsection (a) must also be
2727 attached to any request for payment for the patient's support.
2828 (c) This section applies only to state-operated mental
2929 health facilities.
3030 SECTION 2. Subchapter D, Chapter 592, Health and Safety
3131 Code, is amended by adding Section 592.056 to read as follows:
3232 Sec. 592.056. NOTIFICATION OF TRUST EXEMPTION. (a) At the
3333 time a resident is admitted to a residential care facility, the
3434 facility shall provide to the resident, and the parent if the
3535 resident is a minor or the guardian of the person of the resident,
3636 written notice, in the person's primary language, that a trust that
3737 qualifies under Section 593.081 is not liable for the resident's
3838 support. In addition, the facility shall ensure that, within 24
3939 hours after the resident is admitted to the facility, the
4040 notification is explained to the resident, and the parent if the
4141 resident is a minor or the guardian of the person of the resident:
4242 (1) orally, in simple, nontechnical terms in the
4343 person's primary language, if possible; or
4444 (2) through a means reasonably calculated to
4545 communicate with a person who has an impairment of vision or
4646 hearing, if applicable.
4747 (b) Notice required under Subsection (a) must also be
4848 attached to any request for payment for the resident's support.
4949 SECTION 3. This Act takes effect immediately if it receives
5050 a vote of two-thirds of all the members elected to each house, as
5151 provided by Section 39, Article III, Texas Constitution. If this
5252 Act does not receive the vote necessary for immediate effect, this
5353 Act takes effect September 1, 2009.
