5	5	relating to notification to a patient of a state-operated mental
6	6	health facility or resident of a residential care facility of the
7	7	exemption of certain trusts from liability to pay for support.
8	8	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
9	9	SECTION 1. Subchapter A, Chapter 576, Health and Safety
10	10	Code, is amended by adding Section 576.010 to read as follows:
11	11	Sec. 576.010. NOTIFICATION OF TRUST EXEMPTION. (a) At the
12	12	time a patient is admitted to an inpatient mental health facility
13	13	for voluntary or involuntary inpatient mental health services, the
14	14	facility shall provide to the patient, and the parent if the patient
15	15	is a minor or the guardian of the person of the patient, written
16	16	notice, in the person's primary language, that a trust that
17	17	qualifies under Section 552.018 is not liable for the patient's
18	18	support. In addition, the facility shall ensure that, within 24
19	19	hours after the patient is admitted to the facility, the
20	20	notification is explained to the patient:
21	21	(1) orally, in simple, nontechnical terms in the
22	22	patient's primary language, if possible; or
23	23	(2) through a means reasonably calculated to
24	24	communicate with a patient who has an impairment of vision or
25	25	hearing, if applicable.
26	26	(b) Notice required under Subsection (a) must also be
27	27	attached to any request for payment for the patient's support.
28	28	(c) This section applies only to state-operated mental
29	29	health facilities.
30	30	SECTION 2. Subchapter D, Chapter 592, Health and Safety
31	31	Code, is amended by adding Section 592.056 to read as follows:
32	32	Sec. 592.056. NOTIFICATION OF TRUST EXEMPTION. (a) At the
33	33	time a resident is admitted to a residential care facility, the
34	34	facility shall provide to the resident, and the parent if the
35	35	resident is a minor or the guardian of the person of the resident,
36	36	written notice, in the person's primary language, that a trust that
37	37	qualifies under Section 593.081 is not liable for the resident's
38	38	support. In addition, the facility shall ensure that, within 24
39	39	hours after the resident is admitted to the facility, the
40	40	notification is explained to the resident, and the parent if the
41	41	resident is a minor or the guardian of the person of the resident:
42	42	(1) orally, in simple, nontechnical terms in the
43	43	person's primary language, if possible; or
44	44	(2) through a means reasonably calculated to
45	45	communicate with a person who has an impairment of vision or
46	46	hearing, if applicable.
47	47	(b) Notice required under Subsection (a) must also be
48	48	attached to any request for payment for the resident's support.
49	49	SECTION 3. This Act takes effect immediately if it receives
50	50	a vote of two-thirds of all the members elected to each house, as
51	51	provided by Section 39, Article III, Texas Constitution. If this
52	52	Act does not receive the vote necessary for immediate effect, this
53	53	Act takes effect September 1, 2009.
