55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the expansion of services provided under the child
88 health plan program for certain adolescents.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 62.151, Health and Safety Code, is
1111 amended by amending Subsection (c) and adding Subsection (c-1) to
1212 read as follows:
1313 (c) In developing the plan, the commission, except as
1414 provided by Subsection (c-1), shall ensure that primary and
1515 preventive health benefits do not include reproductive services,
1616 other than prenatal care and care related to diseases, illnesses,
1717 or abnormalities related to the reproductive system.
1818 (c-1) The commission shall ensure that an enrolled
1919 adolescent who is at least 16 years of age has access to
2020 comprehensive family planning services, except services related to
2121 abortion or emergency contraception, as a covered benefit if the
2222 adolescent already has at least one child.
2323 SECTION 2. If before implementing any provision of this Act
2424 a state agency determines that a waiver or authorization from a
2525 federal agency is necessary for implementation of that provision,
2626 the agency affected by the provision shall request the waiver or
2727 authorization and may delay implementing that provision until the
2828 waiver or authorization is granted.
2929 SECTION 3. This Act takes effect September 1, 2009.
