| 7 | 7 | | relating to the expansion of services provided under the child |
|---|
| 8 | 8 | | health plan program for certain adolescents. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 62.151, Health and Safety Code, is |
|---|
| 11 | 11 | | amended by amending Subsection (c) and adding Subsection (c-1) to |
|---|
| 12 | 12 | | read as follows: |
|---|
| 13 | 13 | | (c) In developing the plan, the commission, except as |
|---|
| 14 | 14 | | provided by Subsection (c-1), shall ensure that primary and |
|---|
| 15 | 15 | | preventive health benefits do not include reproductive services, |
|---|
| 16 | 16 | | other than prenatal care and care related to diseases, illnesses, |
|---|
| 17 | 17 | | or abnormalities related to the reproductive system. |
|---|
| 18 | 18 | | (c-1) The commission shall ensure that an enrolled |
|---|
| 19 | 19 | | adolescent who is at least 16 years of age has access to |
|---|
| 20 | 20 | | comprehensive family planning services, except services related to |
|---|
| 21 | 21 | | abortion or emergency contraception, as a covered benefit if the |
|---|
| 22 | 22 | | adolescent already has at least one child. |
|---|
| 23 | 23 | | SECTION 2. If before implementing any provision of this Act |
|---|
| 24 | 24 | | a state agency determines that a waiver or authorization from a |
|---|
| 25 | 25 | | federal agency is necessary for implementation of that provision, |
|---|
| 26 | 26 | | the agency affected by the provision shall request the waiver or |
|---|
| 27 | 27 | | authorization and may delay implementing that provision until the |
|---|
| 28 | 28 | | waiver or authorization is granted. |
|---|
| 29 | 29 | | SECTION 3. This Act takes effect September 1, 2009. |
