 A BILL TO BE ENTITLED
 AN ACT
 relating to the expansion of services provided under the child
 health plan program for certain adolescents.
 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 SECTION 1. Section 62.151, Health and Safety Code, is
 amended by amending Subsection (c) and adding Subsection (c-1) to
 read as follows:
 (c) In developing the plan, the commission, except as
 provided by Subsection (c-1), shall ensure that primary and
 preventive health benefits do not include reproductive services,
 other than prenatal care and care related to diseases, illnesses,
 or abnormalities related to the reproductive system.
 (c-1)  The commission shall ensure that an enrolled
 adolescent who is at least 16 years of age has access to
 comprehensive family planning services, except services related to
 abortion or emergency contraception, as a covered benefit if the
 adolescent already has at least one child.
 SECTION 2. If before implementing any provision of this Act
 a state agency determines that a waiver or authorization from a
 federal agency is necessary for implementation of that provision,
 the agency affected by the provision shall request the waiver or
 authorization and may delay implementing that provision until the
 waiver or authorization is granted.
 SECTION 3. This Act takes effect September 1, 2009.
