55 relating to the operation of certain institutions of higher
66 education as general academic teaching institutions and to the
77 statutory limitation imposed on certain university systems to issue
88 revenue bonds to fund facilities at certain institutions of higher
99 education.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subsection (d), Section 87.841, Education Code,
1212 is amended to read as follows:
1313 (d) Notwithstanding any other provision of this subchapter,
1414 Texas A&M University--San Antonio may not operate as a general
1515 academic teaching institution until the Texas Higher Education
1616 Coordinating Board certifies that enrollment at the Texas A&M
1717 University--Kingsville System Center--San Antonio has reached an
1818 enrollment equivalent of[:
1919 [(1)] 1,000 full-time students for one semester [if
2020 the legislature authorizes revenue bonds to be issued to finance
2121 educational and related facilities for the institution, and the
2222 bonds are issued for that purpose; or
2323 [(2) 2,500 full-time students for one semester if the
2424 conditions specified by Subdivision (1) are not satisfied].
2525 SECTION 2. Subsection (d), Section 105.501, Education Code,
2626 is amended to read as follows:
2727 (d) Notwithstanding any other provision of this subchapter,
2828 the University of North Texas at Dallas may operate as a general
2929 academic teaching institution with its own chief executive officer,
3030 administration, and faculty only after the Texas Higher Education
3131 Coordinating Board certifies that enrollment at the University of
3232 North Texas System Center at Dallas has reached an enrollment
3333 equivalent to 1,000 full-time students for one semester. Until
3434 that enrollment level is reached, the board may operate a system
3535 center of the University of North Texas in the city of Dallas.
3636 [Prior to reaching 2,500 full-time equivalent students, the
3737 University of North Texas at Dallas may not receive general revenue
3838 in excess of the 2003 expended amount with the exception of funding
3939 provided through the General Academic Instruction and Operations
4040 Formula for semester credit hour increases and the Tuition Revenue
4141 Bond debt service for bonds approved in the 78th Legislature. The
4242 institution will not be eligible to receive the small school
4343 supplement in the General Academic Instruction and Operations
4444 Formula until it reaches 2,500 full-time equivalent student
4545 enrollment.]
4646 SECTION 3. The following statutes are repealed:
4747 (1) Subsections (d) and (e), Section 55.1751,
4848 Education Code; and
4949 (2) Subsection (d), Section 55.1755, Education Code.
5050 SECTION 4. This Act does not make an appropriation. This
5151 Act takes effect only if a specific appropriation for the
5252 implementation of the Act is provided in a general appropriations
5353 act of the 81st Legislature.
5454 SECTION 5. Except as otherwise provided by this Act, this
5555 Act takes effect immediately if it receives a vote of two-thirds of
5656 all the members elected to each house, as provided by Section 39,
5757 Article III, Texas Constitution. If this Act does not receive the
5858 vote necessary for immediate effect, this Act takes effect
5959 September 1, 2009, except as otherwise provided by this Act.
