7 | 7 | | statutory limitation imposed on certain university systems to issue |

8 | 8 | | revenue bonds to fund facilities at certain institutions of higher |
---|
9 | 9 | | education. |

10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
---|
11 | 11 | | SECTION 1. Subsection (d), Section 87.841, Education Code, |
---|
12 | 12 | | is amended to read as follows: |
---|
13 | 13 | | (d) Notwithstanding any other provision of this subchapter, |
---|
14 | 14 | | Texas A&M University--San Antonio may not operate as a general |
---|
15 | 15 | | academic teaching institution until the Texas Higher Education |
---|
16 | 16 | | Coordinating Board certifies that enrollment at the Texas A&M |
---|
17 | 17 | | University--Kingsville System Center--San Antonio has reached an |
---|
18 | 18 | | enrollment equivalent of[: |
---|
19 | 19 | | [(1)] 1,000 full-time students for one semester [if |
---|
20 | 20 | | the legislature authorizes revenue bonds to be issued to finance |
---|
21 | 21 | | educational and related facilities for the institution, and the |
---|
22 | 22 | | bonds are issued for that purpose; or |
---|
23 | 23 | | [(2) 2,500 full-time students for one semester if the |
---|
24 | 24 | | conditions specified by Subdivision (1) are not satisfied]. |
---|
25 | 25 | | SECTION 2. Subsection (d), Section 105.501, Education Code, |
---|
26 | 26 | | is amended to read as follows: |
---|
27 | 27 | | (d) Notwithstanding any other provision of this subchapter, |
---|
28 | 28 | | the University of North Texas at Dallas may operate as a general |
---|
29 | 29 | | academic teaching institution with its own chief executive officer, |
---|
30 | 30 | | administration, and faculty only after the Texas Higher Education |
---|
31 | 31 | | Coordinating Board certifies that enrollment at the University of |
---|
32 | 32 | | North Texas System Center at Dallas has reached an enrollment |
---|
33 | 33 | | equivalent to 1,000 full-time students for one semester. Until |
---|
34 | 34 | | that enrollment level is reached, the board may operate a system |
---|
35 | 35 | | center of the University of North Texas in the city of Dallas. |
---|
36 | 36 | | [Prior to reaching 2,500 full-time equivalent students, the |
---|
37 | 37 | | University of North Texas at Dallas may not receive general revenue |
---|
38 | 38 | | in excess of the 2003 expended amount with the exception of funding |
---|
39 | 39 | | provided through the General Academic Instruction and Operations |
---|
40 | 40 | | Formula for semester credit hour increases and the Tuition Revenue |
---|
41 | 41 | | Bond debt service for bonds approved in the 78th Legislature. The |
---|
42 | 42 | | institution will not be eligible to receive the small school |
---|
43 | 43 | | supplement in the General Academic Instruction and Operations |
---|
44 | 44 | | Formula until it reaches 2,500 full-time equivalent student |
---|
45 | 45 | | enrollment.] |
---|
46 | 46 | | SECTION 3. The following statutes are repealed: |
---|
47 | 47 | | (1) Subsections (d) and (e), Section 55.1751, |
---|
48 | 48 | | Education Code; and |
---|
49 | 49 | | (2) Subsection (d), Section 55.1755, Education Code. |
---|
50 | 50 | | SECTION 4. This Act does not make an appropriation. This |
---|
51 | 51 | | Act takes effect only if a specific appropriation for the |
---|
52 | 52 | | implementation of the Act is provided in a general appropriations |
---|
53 | 53 | | act of the 81st Legislature. |
---|
54 | 54 | | SECTION 5. Except as otherwise provided by this Act, this |
---|
55 | 55 | | Act takes effect immediately if it receives a vote of two-thirds of |
---|
56 | 56 | | all the members elected to each house, as provided by Section 39, |
---|
57 | 57 | | Article III, Texas Constitution. If this Act does not receive the |
---|
58 | 58 | | vote necessary for immediate effect, this Act takes effect |
---|
59 | 59 | | September 1, 2009, except as otherwise provided by this Act. |
