66 AN ACT
77 relating to design and construction standards for newly constructed
88 state buildings, public school facilities, and higher education
99 facilities.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter I, Chapter 2166, Government Code, is
1212 amended by adding Section 2166.409 to read as follows:
1313 Sec. 2166.409. HIGH-PERFORMANCE, SUSTAINABLE DESIGN AND
1414 CONSTRUCTION SPECIFICATIONS FOR NEW STATE BUILDING. (a) This
1515 section applies to the construction of a state building, including
1616 a building construction project otherwise exempt from this chapter
1717 under Section 2166.003, except that this section does not apply to a
1818 project constructed by and for an institution of higher education
1919 as defined by Section 61.003, Education Code.
2020 (b) A building to which this section applies must be
2121 designed and constructed so that the building may be certified
2222 under the United States Green Building Council's Leadership in
2323 Energy and Environmental Design (LEED) rating system as that
2424 standard exists as of September 1, 2009.
2525 (c) The commission shall adopt rules for the administration
2626 of this section. The rules may establish an exception to the
2727 application of this section for a type of building if the commission
2828 determines that:
2929 (1) the standards described by Subsection (b) do not
3030 apply to that type of building; or
3131 (2) there is no practical way to apply the standards
3232 described by Subsection (b) to the design and construction of that
3333 type of building.
3434 (d) The commission shall:
3535 (1) monitor and document:
3636 (A) each state agency's compliance with this
3737 section; and
3838 (B) any operating savings resulting from the
3939 design and construction of buildings in accordance with this
4040 section; and
4141 (2) not later than September 1 of each even-numbered
4242 year, submit to the legislature and governor a report regarding:
4343 (A) the commission's findings under Subdivision
4444 (1);
4545 (B) any instances in which, and the reasons for
4646 which, a state building was not designed and constructed in the
4747 manner provided by Subsection (b); and
4848 (C) any recommendations the commission considers
4949 appropriate.
5050 SECTION 2. Subchapter Z, Chapter 44, Education Code, is
5151 amended by adding Section 44.904 to read as follows:
5252 Sec. 44.904. HIGH-PERFORMANCE, SUSTAINABLE DESIGN AND
5353 CONSTRUCTION SPECIFICATIONS FOR CERTAIN NEWLY CONSTRUCTED
5454 FACILITIES. (a) In this section, "instructional facility" has the
5555 meaning assigned by Section 46.001.
5656 (b) This section applies to a newly constructed
5757 instructional facility of a school district.
5858 (c) A facility to which this section applies must be
5959 designed and constructed so that the facility may be certified
6060 under the United States Green Building Council's Leadership in
6161 Energy and Environmental Design (LEED) rating system as that
6262 standard exists as of September 1, 2009.
6363 (d) The agency shall adopt rules for the administration of
6464 this section. The rules may establish an exception to the
6565 application of this section for a type of facility if the agency
6666 determines that:
6767 (1) the standards described by Subsection (c) do not
6868 apply to that type of facility; or
6969 (2) there is no practical way to apply the standards
7070 described by Subsection (c) to the design and construction of that
7171 type of facility.
7272 (e) The agency shall:
7373 (1) monitor and document:
7474 (A) each district's compliance with this
7575 section; and
7676 (B) any operating savings resulting from the
7777 design and construction of facilities in accordance with this
7878 section; and
7979 (2) not later than September 1 of each even-numbered
8080 year, submit to the legislature and governor a report regarding:
8181 (A) the agency's findings under Subdivision (1);
8282 (B) any instances in which, and the reasons for
8383 which, a facility was not designed and constructed in the manner
8484 provided by Subsection (c); and
8585 (C) any recommendations the agency considers
8686 appropriate.
8787 SECTION 3. Subchapter C, Chapter 61, Education Code, is
8888 amended by adding Section 61.0584 to read as follows:
8989 Sec. 61.0584. HIGH-PERFORMANCE, SUSTAINABLE DESIGN AND
9090 CONSTRUCTION SPECIFICATIONS FOR CERTAIN NEWLY CONSTRUCTED
9191 FACILITIES. (a) This section applies to a newly constructed
9292 facility of an institution of higher education.
9393 (b) A facility to which this section applies must be
9494 designed and constructed so that the facility may be certified
9595 under the United States Green Building Council's Leadership in
9696 Energy and Environmental Design (LEED) rating system as that
9797 standard exists as of September 1, 2009.
9898 (c) The board shall adopt rules for the administration of
9999 this section. The rules may establish an exception to the
100100 application of this section for a type of facility if the board
101101 determines that:
102102 (1) the standards described by Subsection (b) do not
103103 apply to that type of facility; or
104104 (2) there is no practical way to apply the standards
105105 described by Subsection (b) to the design and construction of that
106106 type of facility.
107107 (d) The board shall:
108108 (1) monitor and document:
109109 (A) each institution's compliance with this
110110 section; and
111111 (B) any operating savings resulting from the
112112 design and construction of facilities in accordance with this
113113 section; and
114114 (2) not later than September 1 of each even-numbered
115115 year, submit to the legislature and governor a report regarding:
116116 (A) the board's findings under Subdivision (1);
117117 (B) any instances in which, and the reasons for
118118 which, a facility was not designed and constructed in the manner
119119 provided by Subsection (b); and
120120 (C) any recommendations the board considers
121121 appropriate.
122122 SECTION 4. (a) The Texas Facilities Commission shall
123123 establish and appoint members to an advisory committee to make
124124 recommendations to and advise the commission on the implementation
125125 of the design and construction specifications required by this Act.
126126 The advisory committee must include representatives of:
127127 (1) the design and construction industry involved in
128128 public building contracts;
129129 (2) the Texas Education Agency;
130130 (3) the Texas Higher Education Coordinating Board;
131131 (4) institutions of higher education; and
132132 (5) public school districts.
133133 (b) This section expires and the advisory committee is
134134 abolished September 1, 2011.
135135 SECTION 5. (a) The state auditor shall prepare a report
136136 concerning the implementation of the design and construction
137137 specifications required by this Act and shall present the report to
138138 the 83rd Legislature not later than January 15, 2013. The report
139139 must include:
140140 (1) the costs of implementing the specifications;
141141 (2) the operating savings attributable to
142142 implementing the specifications, including energy and maintenance
143143 savings;
144144 (3) any impact on employee productivity and student
145145 performance resulting from implementing the specifications;
146146 (4) the effectiveness of the implementation of the
147147 specifications; and
148148 (5) any recommendations the state auditor considers
149149 appropriate.
150150 (b) This section expires January 16, 2013.
151151 SECTION 6. Sections 44.904 and 61.0584, Education Code, and
152152 Section 2166.409, Government Code, as added by this Act, apply only
153153 to the construction of a facility or building for which the contract
154154 for design services is entered into on or after September 1, 2009.
155155 SECTION 7. This Act takes effect September 1, 2009.
