| 6 | 6 | | relating to the sunset review of certain river authorities. |

| 7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 8 | | SECTION 1. SUNSET ACT. Chapter 325, Government Code, is |
|---|
| 9 | 9 | | amended by adding Section 325.025 to read as follows: |
|---|
| 10 | 10 | | Sec. 325.025. CERTAIN RIVER AUTHORITIES AND OTHER WATER |
|---|
| 11 | 11 | | AUTHORITIES SUBJECT TO REVIEW AND ABOLISHMENT. (a) A river |
|---|
| 12 | 12 | | authority or water authority listed in Subsection (b) is subject to |
|---|
| 13 | 13 | | review under this chapter as if it were a state agency. |
|---|
| 14 | 14 | | (b) This section applies only to the: |
|---|
| 15 | 15 | | (1) Brazos River Authority; |
|---|
| 16 | 16 | | (2) Guadalupe-Blanco River Authority; and |
|---|
| 17 | 17 | | (3) Lower Colorado River Authority. |
|---|
| 18 | 18 | | (c) A river authority or water authority shall pay the cost |
|---|
| 19 | 19 | | incurred by the commission in performing a review of the authority |
|---|
| 20 | 20 | | under this section. The commission shall determine the cost, and |
|---|
| 21 | 21 | | the authority shall pay the amount promptly on receipt of a |
|---|
| 22 | 22 | | statement from the commission detailing the cost. |
|---|
| 23 | 23 | | SECTION 2. BRAZOS RIVER AUTHORITY. Chapter 8502, Special |
|---|
| 24 | 24 | | District Local Laws Code, is amended by adding Section 8502.0021 to |
|---|
| 25 | 25 | | read as follows: |
|---|
| 26 | 26 | | Sec. 8502.0021. APPLICATION OF SUNSET ACT. The authority |
|---|
| 27 | 27 | | is subject to review for the purposes of Chapter 325, Government |
|---|
| 28 | 28 | | Code, but may not be abolished under that chapter. The review shall |
|---|
| 29 | 29 | | be conducted as if the authority were scheduled to be abolished |
|---|
| 30 | 30 | | September 1, 2013. |
|---|
| 31 | 31 | | SECTION 3. GUADALUPE-BLANCO RIVER AUTHORITY. Chapter 75, |
|---|
| 32 | 32 | | Acts of the 43rd Legislature, 1st Called Session, 1933, is amended |
|---|
| 33 | 33 | | by adding Section 1A to read as follows: |
|---|
| 34 | 34 | | Sec. 1A. The District is subject to review for the purposes |
|---|
| 35 | 35 | | of Chapter 325, Government Code, but may not be abolished under that |
|---|
| 36 | 36 | | chapter. The review shall be conducted as if the District were |
|---|
| 37 | 37 | | scheduled to be abolished September 1, 2015. |

| 38 | 38 | | SECTION 4. LOWER COLORADO RIVER AUTHORITY. Chapter 8503, |
|---|
| 39 | 39 | | Special District Local Laws Code, is amended by adding Section |
|---|
| 40 | 40 | | 8503.0021 to read as follows: |
|---|
| 41 | 41 | | Sec. 8503.0021. APPLICATION OF SUNSET ACT. The authority |
|---|
| 42 | 42 | | is subject to review for the purposes of Chapter 325, Government |
|---|
| 43 | 43 | | Code, but may not be abolished under that chapter. The review shall |
|---|
| 44 | 44 | | be conducted as if the authority were scheduled to be abolished |
|---|
| 45 | 45 | | September 1, 2011. |
|---|
| 46 | 46 | | SECTION 5. EFFECTIVE DATE. This Act takes effect |
|---|
| 47 | 47 | | immediately if it receives a vote of two-thirds of all the members |
|---|
| 48 | 48 | | elected to each house, as provided by Section 39, Article III, Texas |
|---|
| 49 | 49 | | Constitution. If this Act does not receive the vote necessary for |
|---|
| 50 | 50 | | immediate effect, this Act takes effect September 1, 2009. |
