77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Section 39.032, Education Code, is amended by
99 amending Subsection (c) and adding Subsections (c-1) and (c-2) to
1010 read as follows:
1111 (c) State and national norms of averages shall be computed
1212 using data that are not more than eight [six] years old at the time
1313 the assessment instrument is administered and that are
1414 representative of the group of students to whom the assessment
1515 instrument is administered.
1616 (c-1) The standardization norms computed under Subsection
1717 (c) shall be:
1818 (1) based on a national probability sample that meets
1919 accepted standards for educational and psychological testing; and
2020 (2) [shall be] updated at least every eight [six]
2121 years using proven psychometric procedures approved by the State
2222 Board of Education.
2323 (c-2) The eight-year limitation on data to compute norms
2424 under this section does not apply if only data older than eight
2525 years is available for an assessment instrument. The commissioner
2626 by rule may limit the exception created by this subsection based on
2727 the type of assessment instrument.
2828 SECTION 2. Subsections (a), (b), and (d), Section 39.032,
2929 Education Code, are repealed.
3030 SECTION 3. This Act takes effect immediately if it receives
3131 a vote of two-thirds of all the members elected to each house, as
3232 provided by Section 39, Article III, Texas Constitution. If this
3333 Act does not receive the vote necessary for immediate effect, this
3434 Act takes effect September 1, 2009.
