7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

8 | 8 | | SECTION 1. Section 39.032, Education Code, is amended by |
---|
9 | 9 | | amending Subsection (c) and adding Subsections (c-1) and (c-2) to |
---|
10 | 10 | | read as follows: |
---|
11 | 11 | | (c) State and national norms of averages shall be computed |
---|
12 | 12 | | using data that are not more than eight [six] years old at the time |
---|
13 | 13 | | the assessment instrument is administered and that are |
---|
14 | 14 | | representative of the group of students to whom the assessment |
---|
15 | 15 | | instrument is administered. |
---|
16 | 16 | | (c-1) The standardization norms computed under Subsection |
---|
17 | 17 | | (c) shall be: |
---|
18 | 18 | | (1) based on a national probability sample that meets |
---|
19 | 19 | | accepted standards for educational and psychological testing; and |
---|
20 | 20 | | (2) [shall be] updated at least every eight [six] |
---|
21 | 21 | | years using proven psychometric procedures approved by the State |
---|
22 | 22 | | Board of Education. |
---|
23 | 23 | | (c-2) The eight-year limitation on data to compute norms |
---|
24 | 24 | | under this section does not apply if only data older than eight |
---|
25 | 25 | | years is available for an assessment instrument. The commissioner |
---|
26 | 26 | | by rule may limit the exception created by this subsection based on |
---|
27 | 27 | | the type of assessment instrument. |
---|
28 | 28 | | SECTION 2. Subsections (a), (b), and (d), Section 39.032, |
---|
29 | 29 | | Education Code, are repealed. |
---|
30 | 30 | | SECTION 3. This Act takes effect immediately if it receives |
---|
31 | 31 | | a vote of two-thirds of all the members elected to each house, as |
---|
32 | 32 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
33 | 33 | | Act does not receive the vote necessary for immediate effect, this |
---|
34 | 34 | | Act takes effect September 1, 2009. |
