| 5 | 5 | | relating to the exemption of certain counties from the drainage |

| 6 | 6 | | charge imposed by a municipal drainage utility system. |

| 7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 8 | | SECTION 1. Section 552.053, Local Government Code, as |
|---|
| 9 | 9 | | effective April 1, 2009, is amended by adding Subsection (e) to read |
|---|
| 10 | 10 | | as follows: |
|---|
| 11 | 11 | | (e) Property owned by a county in which a municipality |
|---|
| 12 | 12 | | described by Section 552.044(8)(A) is located is exempt from |
|---|
| 13 | 13 | | drainage charges under Section 552.047 and all ordinances, |
|---|
| 14 | 14 | | resolutions, and rules adopted under this subchapter. |
|---|
| 15 | 15 | | SECTION 2. The changes in law made by this Act apply only to |
|---|
| 16 | 16 | | a charge assessed, billed, or collected by a municipality on or |
|---|
| 17 | 17 | | after the effective date of this Act. A charge assessed, billed, or |
|---|
| 18 | 18 | | collected by a municipality before the effective date of this Act is |
|---|
| 19 | 19 | | governed by the law in effect on the date the charge was assessed, |
|---|
| 20 | 20 | | billed, or collected, and the former law is continued in effect for |
|---|
| 21 | 21 | | that purpose. |

| 22 | 22 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 23 | 23 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 24 | 24 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 25 | 25 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 26 | 26 | | Act takes effect September 1, 2009. |
