5	5	relating to the participation in state travel service contracts by
6	6	certain local governmental entities.
7	7	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
8	8	SECTION 1. Section 2171.055, Government Code, is amended by
9	9	adding Subsections (i) and (j) to read as follows:
10	10	(i) An officer or employee of a transportation or transit
11	11	authority, department, district, or system established under
12	12	Subtitle K, Title 6, Transportation Code, who is engaged in
13	13	official business of the authority, department, district, or system
14	14	may participate in the comptroller's contracts for travel services.
15	15	The comptroller may charge a participating authority, department,
16	16	district, or system a fee not to exceed the costs incurred by the
17	17	comptroller in providing services under this subsection. The
18	18	comptroller shall periodically review fees and shall adjust them as
19	19	needed to ensure recovery of costs incurred in providing services
20	20	to authorities, departments, districts, and systems under this
21	21	subsection.
22	22	(j) An officer or employee of a hospital district created
23	23	under general or special law who is engaged in official hospital
24	24	district business may participate in the commission's contract for
25	25	travel services for the purpose of obtaining reduced airline fares
26	26	and reduced travel agent fees. The commission may charge a
27	27	participating hospital district a fee not to exceed the costs
28	28	incurred by the commission in providing services under this
29	29	subsection. The commission shall periodically review fees and
30	30	shall adjust them as needed to ensure recovery of costs incurred in
31	31	providing services to hospital districts under this subsection.
32	32	The commission shall deposit the fees collected under this
33	33	subsection to the credit of the hospital district airline fares
34	34	account. The hospital district airline fares account is an account
35	35	in the general revenue fund that may be appropriated only for the
36	36	purposes of this chapter. The commission shall adopt rules and make
37	37	or amend contracts as necessary to administer this subsection.
38	38	SECTION 2. This Act takes effect immediately if it receives
39	39	a vote of two-thirds of all the members elected to each house, as
40	40	provided by Section 39, Article III, Texas Constitution. If this
41	41	Act does not receive the vote necessary for immediate effect, this
42	42	Act takes effect September 1, 2009.
