| 7 | 7 | | relating to the purchase of a United States flag or Texas flag by a |

| 8 | 8 | | governmental entity. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Chapter 2158, Government Code, is amended by |
|---|
| 11 | 11 | | adding Subchapter H to read as follows: |
|---|
| 12 | 12 | | SUBCHAPTER H. PURCHASE OF UNITED STATES FLAG OR STATE FLAG |
|---|
| 13 | 13 | | Sec. 2158.401. FLAG PROCUREMENT BY STATE GOVERNMENTAL |
|---|
| 14 | 14 | | ENTITY. (a) In this subchapter, "state agency" means: |
|---|
| 15 | 15 | | (1) a department, commission, board, office, or other |
|---|
| 16 | 16 | | agency in the executive or legislative branch created by the |
|---|
| 17 | 17 | | constitution or a statute of this state; |
|---|
| 18 | 18 | | (2) the supreme court, the court of criminal appeals, |
|---|
| 19 | 19 | | a court of appeals, or the Texas Judicial Council; or |
|---|
| 20 | 20 | | (3) a university system or an institution of higher |
|---|
| 21 | 21 | | education as defined by Section 61.003, Education Code. |
|---|
| 22 | 22 | | (b) Each United States flag purchased by a state agency must |
|---|
| 23 | 23 | | be manufactured in the United States. |
|---|
| 24 | 24 | | (c) Each Texas state flag purchased by a state agency must |
|---|
| 25 | 25 | | be manufactured in this state. |
|---|
| 26 | 26 | | (d) A flag is considered to have been manufactured in a |
|---|
| 27 | 27 | | location if a substantial majority of the principal components are |
|---|
| 28 | 28 | | assembled into the final product in an assembly plant in the |
|---|
| 29 | 29 | | location. |

| 30 | 30 | | SECTION 2. Subchapter Z, Chapter 271, Local Government |
|---|
| 31 | 31 | | Code, is amended by adding Section 271.908 to read as follows: |
|---|
| 32 | 32 | | Sec. 271.908. FLAG PROCUREMENT BY GOVERNMENTAL AGENCY. (a) |
|---|
| 33 | 33 | | In this section, "governmental agency" has the meaning assigned by |
|---|
| 34 | 34 | | Section 271.003. |
|---|
| 35 | 35 | | (b) Each United States flag purchased by a governmental |
|---|
| 36 | 36 | | agency must be manufactured in the United States. |
|---|
| 37 | 37 | | (c) Each Texas state flag purchased by a governmental agency |
|---|
| 38 | 38 | | must be manufactured in this state. |
|---|
| 39 | 39 | | (d) A flag is considered to have been manufactured in a |
|---|
| 40 | 40 | | location if a substantial majority of the principal components are |
|---|
| 41 | 41 | | assembled into the final product in an assembly plant in the |
|---|
| 42 | 42 | | location. |
|---|
| 43 | 43 | | SECTION 3. Section 2158.401, Government Code, and Section |
|---|
| 44 | 44 | | 271.908, Local Government Code, as added by this Act apply only to |
|---|
| 45 | 45 | | the purchase of a United States flag or Texas flag made or a |
|---|
| 46 | 46 | | contract for the purchase of a United States flag or Texas flag |
|---|
| 47 | 47 | | entered into on or after the effective date of this Act. |
|---|
| 48 | 48 | | SECTION 4. This Act takes effect September 1, 2009. |
