81R4988 YDB-D By: Williams S.B. No. 907 A BILL TO BE ENTITLED AN ACT relating to the purchase of a United States flag or Texas flag by a governmental entity. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Chapter 2158, Government Code, is amended by adding Subchapter H to read as follows: SUBCHAPTER H. PURCHASE OF UNITED STATES FLAG OR STATE FLAG Sec. 2158.401. FLAG PROCUREMENT BY STATE GOVERNMENTAL ENTITY. (a) In this subchapter, "state agency" means: (1) a department, commission, board, office, or other agency in the executive or legislative branch created by the constitution or a statute of this state; (2) the supreme court, the court of criminal appeals, a court of appeals, or the Texas Judicial Council; or (3) a university system or an institution of higher education as defined by Section 61.003, Education Code. (b) Each United States flag purchased by a state agency must be manufactured in the United States. (c) Each Texas state flag purchased by a state agency must be manufactured in this state. (d) A flag is considered to have been manufactured in a location if a substantial majority of the principal components are assembled into the final product in an assembly plant in the location. SECTION 2. Subchapter Z, Chapter 271, Local Government Code, is amended by adding Section 271.908 to read as follows: Sec. 271.908. FLAG PROCUREMENT BY GOVERNMENTAL AGENCY. (a) In this section, "governmental agency" has the meaning assigned by Section 271.003. (b) Each United States flag purchased by a governmental agency must be manufactured in the United States. (c) Each Texas state flag purchased by a governmental agency must be manufactured in this state. (d) A flag is considered to have been manufactured in a location if a substantial majority of the principal components are assembled into the final product in an assembly plant in the location. SECTION 3. Section 2158.401, Government Code, and Section 271.908, Local Government Code, as added by this Act apply only to the purchase of a United States flag or Texas flag made or a contract for the purchase of a United States flag or Texas flag entered into on or after the effective date of this Act. SECTION 4. This Act takes effect September 1, 2009.
