55 AN ACT
66 relating to contracts by governmental entities for professional
77 services relating to geoscience.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Subdivision (2), Section 2254.002, Government
1010 Code, is amended to read as follows:
1111 (2) "Professional services" means services:
1212 (A) within the scope of the practice, as defined
1313 by state law, of:
1414 (i) accounting;
1515 (ii) architecture;
1616 (iii) landscape architecture;
1717 (iv) land surveying;
1818 (v) medicine;
1919 (vi) optometry;
2020 (vii) professional engineering;
2121 (viii) real estate appraising; [or]
2222 (ix) professional nursing; or
2323 (x) professional geoscience; or
2424 (B) provided in connection with the professional
2525 employment or practice of a person who is licensed or registered as:
2626 (i) a certified public accountant;
2727 (ii) an architect;
2828 (iii) a landscape architect;
2929 (iv) a land surveyor;
3030 (v) a physician, including a surgeon;
3131 (vi) an optometrist;
3232 (vii) a professional engineer;
3333 (viii) a state certified or state licensed
3434 real estate appraiser; [or]
3535 (ix) a registered nurse; or
3636 (x) a professional geoscientist.
3737 SECTION 2. The heading to Section 2254.004, Government
3838 Code, is amended to read as follows:
3939 Sec. 2254.004. CONTRACT FOR PROFESSIONAL SERVICES OF
4040 ARCHITECT, ENGINEER, [OR] SURVEYOR, OR GEOSCIENTIST.
4141 SECTION 3. Subsections (a) and (b), Section 2254.004,
4242 Government Code, are amended to read as follows:
4343 (a) In procuring architectural, engineering, [or] land
4444 surveying, or geoscientific services, a governmental entity shall:
4545 (1) first select the most highly qualified provider of
4646 those services on the basis of demonstrated competence and
4747 qualifications; and
4848 (2) then attempt to negotiate with that provider a
4949 contract at a fair and reasonable price.
5050 (b) If a satisfactory contract cannot be negotiated with the
5151 most highly qualified provider of architectural, engineering, [or]
5252 land surveying, or geoscientific services, the entity shall:
5353 (1) formally end negotiations with that provider;
5454 (2) select the next most highly qualified provider;
5555 and
5656 (3) attempt to negotiate a contract with that provider
5757 at a fair and reasonable price.
5858 SECTION 4. The changes in law made by this Act apply only to
5959 the selection of a provider of professional geoscientific services
6060 or the award of a contract to provide professional geoscientific
6161 services made on or after October 1, 2009.
6262 SECTION 5. This Act takes effect September 1, 2009.
