8 | 8 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
9 | 9 | SECTION 1. Subchapter C, Chapter 791, Government Code, is | |
10 | 10 | amended by adding Section 791.034 to read as follows: | |
11 | 11 | Sec. 791.034. INTERLOCAL CONTRACT FOR RELIEF HIGHWAY ROUTE | |
12 | 12 | AROUND CERTAIN MUNICIPALITIES. (a) The governing body of a | |
13 | 13 | municipality located in a county in which is located a facility | |
14 | 14 | licensed to dispose of low-level radioactive waste under Chapter | |
15 | 15 | 401, Health and Safety Code, may enter into an interlocal contract | |
16 | 16 | with the county for the construction and maintenance of a relief | |
17 | 17 | highway route around and outside the boundaries of the municipality | |
18 | 18 | that the governing body determines will serve a public purpose of | |
19 | 19 | the municipality. | |
20 | 20 | (b) The municipality may expend municipal funds and may | |
21 | 21 | issue certificates of obligation or bonds to pay for expenses | |
22 | 22 | associated with a relief highway route under Subsection (a). | |
23 | 23 | SECTION 2. This Act takes effect immediately if it receives | |
24 | 24 | a vote of two-thirds of all the members elected to each house, as | |
25 | 25 | provided by Section 39, Article III, Texas Constitution. If this | |
26 | 26 | Act does not receive the vote necessary for immediate effect, this | |
27 | 27 | Act takes effect September 1, 2009. |
