44 SENATE JOINT RESOLUTION
55 proposing a constitutional amendment authorizing the legislature
66 by general law to permit counties to assess and collect a local

99 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Article VIII, Texas Constitution, is amended by
1111 adding Section 7-c to read as follows:
1212 Sec. 7-c. (a) The legislature by general law may authorize
1313 a county to:
1414 (1) assess and collect a local tax on the sale of
1515 gasoline and diesel fuel in the county;
1616 (2) assess and collect an additional vehicle
1717 registration fee on a vehicle registered in the county; and
1818 (3) use all revenue derived from the tax and fee for
1919 mobility improvement projects, including acquiring rights-of-way,
2020 constructing and maintaining public roadways of the county, and
2121 providing funding for the construction, maintenance, and operation
2222 of passenger rail, transit, and freight rail systems.
2323 (b) Notwithstanding any other provision of this
2424 constitution, revenue derived from a tax or fee authorized by
2525 Subsection (a) of this section may only be used as provided by that
2626 subsection.
2727 (c) Section 7-a of this article does not apply to a tax
2828 authorized by this section.
2929 SECTION 2. This proposed constitutional amendment shall be
3030 submitted to the voters at an election to be held November 3, 2009.
3131 The ballot shall be printed to permit voting for or against the
3232 proposition: "The constitutional amendment authorizing the
3333 legislature by general law to permit counties to assess and collect
3434 a local motor fuels tax and an additional vehicle registration fee
3535 to be used for mobility improvement projects."
