| 6 | 6 | | Legislature, Regular Session, 2009, That Senate Rule 12.03 be |

| 7 | 7 | | suspended in part as provided by Senate Rule 12.08 to enable the |
|---|
| 8 | 8 | | conference committee appointed to resolve the differences on |
|---|
| 9 | 9 | | Senate Bill No. 1263 (certain mass transit entities) to consider |
|---|
| 10 | 10 | | and take action on the following matters: |
|---|
| 11 | 11 | | (1) Senate Rules 12.03(1) and (4) are suspended to permit |
|---|
| 12 | 12 | | the committee to change text not in disagreement and add text not |
|---|
| 13 | 13 | | included in either version of the bill under Section 7 of the bill |
|---|
| 14 | 14 | | in amended Subdivision (2), Subsection (b), Section 451.5021, |
|---|
| 15 | 15 | | Transportation Code, to read as follows: |
|---|
| 16 | 16 | | (2) two members, one who must be and one who may be |
|---|
| 17 | 17 | | an elected official, [two members] appointed by the governing |
|---|
| 18 | 18 | | body of the principal municipality; |

| 19 | 19 | | Explanation: The change is necessary because of the two |
|---|
| 20 | 20 | | members of the board appointed by the municipality, only one must |
|---|
| 21 | 21 | | be an elected official. |

| 22 | 22 | | (2) Senate Rules 12.03(1) and (2) are suspended to permit |
|---|
| 23 | 23 | | the committee to change and omit text not in disagreement in |
|---|
| 24 | 24 | | Section 7 of the bill in amended Subdivisions (3) and (4), |

| 25 | 25 | | Subsection (b), Section 451.5021, Transportation Code, so that |

| 26 | 26 | | the text reads as follows: |

| 34 | 34 | | mayor of the principal municipality]; [and] |
|---|
| 35 | 35 | | Explanation: The alteration of text is necessary because |
|---|
| 36 | 36 | | the members under these subdivisions will not be jointly |
|---|
| 37 | 37 | | appointed. |

| 38 | 38 | | (3) Senate Rules 12.03(1) and (4) are suspended to permit |
|---|
| 39 | 39 | | the committee to change text not in disagreement and add text not |
|---|
| 40 | 40 | | included in either version of the bill in Section 7 of the bill in |

| 41 | 41 | | the introduction of amended Subsection (d), Section 451.5021, |

| 42 | 42 | | Transportation Code, so that it reads as follows: |

| 58 | 58 | | (d-3) A person appointed under Subsection (b)(4) must: |

| 59 | 59 | | (1) have the person's principal place of occupation |
|---|
| 60 | 60 | | or employment in the portion of the authority's service area that |
|---|
| 61 | 61 | | is located in the county, other than the principal county, that |
|---|
| 62 | 62 | | has the largest population of the counties in the authority; or |
|---|
| 63 | 63 | | (2) be a qualified voter of the county, other than |
|---|
| 64 | 64 | | the principal county, that has the largest population of the |
|---|
| 65 | 65 | | counties in the authority. |

| 66 | 66 | | Explanation: The changes delete text that was in error or |

|---|
