44 SENATE RESOLUTION
55 BE IT RESOLVED by the Senate of the State of Texas, 81st
66 Legislature, Regular Session, 2009, That Senate Rule 12.03 be
77 suspended in part as provided by Senate Rule 12.08 to enable the
88 conference committee appointed to resolve the differences on
99 Senate Bill No. 1263 (certain mass transit entities) to consider
1010 and take action on the following matters:
1111 (1) Senate Rules 12.03(1) and (4) are suspended to permit
1212 the committee to change text not in disagreement and add text not
1313 included in either version of the bill under Section 7 of the bill
1414 in amended Subdivision (2), Subsection (b), Section 451.5021,
1515 Transportation Code, to read as follows:
1616 (2) two members, one who must be and one who may be
1717 an elected official, [two members] appointed by the governing
1818 body of the principal municipality;
1919 Explanation: The change is necessary because of the two
2020 members of the board appointed by the municipality, only one must
2121 be an elected official.
2222 (2) Senate Rules 12.03(1) and (2) are suspended to permit
2323 the committee to change and omit text not in disagreement in
2424 Section 7 of the bill in amended Subdivisions (3) and (4),
2525 Subsection (b), Section 451.5021, Transportation Code, so that
2626 the text reads as follows:
2727 (3) one member appointed by the commissioners court
2828 of the principal county;
2929 (4) one member appointed by the commissioners court
3030 of the county, excluding the principal county, that has the
3131 largest population of the counties in the authority [a panel
3232 composed of the mayors of all the municipalities in the authority
3333 located in the principal county of the authority, excluding the
3434 mayor of the principal municipality]; [and]
3535 Explanation: The alteration of text is necessary because
3636 the members under these subdivisions will not be jointly
3737 appointed.
3838 (3) Senate Rules 12.03(1) and (4) are suspended to permit
3939 the committee to change text not in disagreement and add text not
4040 included in either version of the bill in Section 7 of the bill in
4141 the introduction of amended Subsection (d), Section 451.5021,
4242 Transportation Code, so that it reads as follows:
4343 (d) A person appointed under Subsection (b)(1), (2)
4444 [(b)(2), (3), (4)], or (5), except as provided by Subsection
4545 (b)(2):
4646 Explanation: The new text is needed to refer to the
4747 exception to this subsection under Subsection (b)(2).
4848 (4) Senate Rules 12.03(1) and (2) are suspended to permit
4949 the committee to change and omit text not in disagreement in
5050 Section 7 of the bill, in added Subsections (d-2) and (d-3),
5151 Section 451.5021, Transportation Code, so that the text reads as
5252 follows:
5353 (d-2) A person appointed under Subsection (b)(3) must:
5454 (1) have the person's principal place of occupation
5555 or employment in the portion of the authority's service area that
5656 is located in the principal county; or
5757 (2) be a qualified voter of the principal county.
5858 (d-3) A person appointed under Subsection (b)(4) must:
5959 (1) have the person's principal place of occupation
6060 or employment in the portion of the authority's service area that
6161 is located in the county, other than the principal county, that
6262 has the largest population of the counties in the authority; or
6363 (2) be a qualified voter of the county, other than
6464 the principal county, that has the largest population of the
6565 counties in the authority.
6666 Explanation: The changes delete text that was in error or
6767 that is not necessary because of the change from joint
6868 appointments under Subdivisions (3) and (4), Subsection (b).
