| 12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 13 | 13 | | SECTION 1. Subchapter B, Chapter 1043, Special District |
|---|
| 14 | 14 | | Local Laws Code, is amended by adding Section 1043.0535 to read as |
|---|
| 15 | 15 | | follows: |
|---|
| 16 | 16 | | Sec. 1043.0535. GROUNDS FOR REMOVAL. (a) It is a ground |
|---|
| 17 | 17 | | for removal from the board that a director is absent from at least |
|---|
| 18 | 18 | | four regularly scheduled board meetings that the director is |
|---|
| 19 | 19 | | eligible to attend in any 12-month period without an excuse |
|---|
| 20 | 20 | | approved by a majority vote of the board. |
|---|
| 21 | 21 | | (b) The validity of an action of the board is not affected by |
|---|
| 22 | 22 | | the fact that the action is taken when a ground for removal of a |
|---|
| 23 | 23 | | director exists. |
|---|
| 24 | 24 | | (c) A director may be removed for a ground provided by this |
|---|
| 25 | 25 | | section using the procedures provided by Subchapter B, Chapter 87, |
|---|
| 26 | 26 | | Local Government Code, for removing a county official. |
|---|
| 27 | 27 | | SECTION 2. Section 1043.155(a), Special District Local Laws |
|---|
| 28 | 28 | | Code, is amended to read as follows: |
|---|
| 29 | 29 | | (a) The board by resolution shall designate a bank or banks |
|---|
| 30 | 30 | | in Hopkins County as the district's depository or treasurer. A |
|---|
| 31 | 31 | | designated bank serves for three [two] years and until a successor |
|---|
| 32 | 32 | | is designated. |
|---|
| 33 | 33 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 34 | 34 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 35 | 35 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 36 | 36 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 37 | 37 | | Act takes effect September 1, 2011. |
