1010 AN ACT
1111 relating to the Hopkins County Hospital District.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Subchapter B, Chapter 1043, Special District
1414 Local Laws Code, is amended by adding Section 1043.0535 to read as
1515 follows:
1616 Sec. 1043.0535. GROUNDS FOR REMOVAL. (a) It is a ground
1717 for removal from the board that a director is absent from at least
1818 four regularly scheduled board meetings that the director is
1919 eligible to attend in any 12-month period without an excuse
2020 approved by a majority vote of the board.
2121 (b) The validity of an action of the board is not affected by
2222 the fact that the action is taken when a ground for removal of a
2323 director exists.
2424 (c) A director may be removed for a ground provided by this
2525 section using the procedures provided by Subchapter B, Chapter 87,
2626 Local Government Code, for removing a county official.
2727 SECTION 2. Section 1043.155(a), Special District Local Laws
2828 Code, is amended to read as follows:
2929 (a) The board by resolution shall designate a bank or banks
3030 in Hopkins County as the district's depository or treasurer. A
3131 designated bank serves for three [two] years and until a successor
3232 is designated.
3333 SECTION 3. This Act takes effect immediately if it receives
3434 a vote of two-thirds of all the members elected to each house, as
3535 provided by Section 39, Article III, Texas Constitution. If this
3636 Act does not receive the vote necessary for immediate effect, this
3737 Act takes effect September 1, 2011.
