A BILL TO BE ENTITLED
AN ACT
relating to the Hopkins County Hospital District.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Subchapter B, Chapter 1043, Special District
Local Laws Code, is amended by adding Section 1043.0535 to read as
follows:
Sec. 1043.0535. GROUNDS FOR REMOVAL. (a) It is a ground
for removal from the board that a director is absent from at least
four regularly scheduled board meetings that the director is
eligible to attend in any 12-month period without an excuse
approved by a majority vote of the board.
(b) The validity of an action of the board is not affected by
the fact that the action is taken when a ground for removal of a
director exists.
(c) A director may be removed for a ground provided by this
section using the procedures provided by Subchapter B, Chapter 87,
Local Government Code, for removing a county official.
SECTION 2. Section 1043.155(a), Special District Local Laws
Code, is amended to read as follows:
(a) The board by resolution shall designate a bank or banks
in Hopkins County as the district's depository or treasurer. A
designated bank serves for three [two] years and until a successor
is designated.
SECTION 3. This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution. If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2011.
